What are my chances of an exchange with no receipt?

Little boy had fisher price bandstand bought for him off granny for Christmas. He has hardly used it (not a favourite toy at all). I have just switched it on and the monkey on the top wont spin round properly (keeps jamming). Mother in law doesnt have receipt but I still have the box with the Argos code on - do you think they will give me an exchange? Have looked on the website and it is now a clearance item at a lot cheaper than I think she payed for it!

Ive taken stuff back without a receipt before & got vouchers, i would think you should stand a good chance of getting an exchange after all you have nothing to loose in asking.0

If its a clearance item then chances are they no longer do it to replace it. Possibly they could get in contact with the manufacturer to see about sorting out the fault for you. Depending on the goodwill of the staff you may be able to get a giftcard refund to chose another toy but without any proof of the price that was paid, you would be offered only the last/current selling price.0

if it is faulty and cannot be repaired/replaced, you should be offered a refund.

Thanks everyone for your replies - plan to go into Argos on Monday so fingers crossed I at least get vouchers so he can have another toy (not that we need any more - currently doing car boots to try and get rid of some of them!!).0

Success - I love Argos!
Took it back today and asked for an exchange - as its a clearance item they had no stock so I was given the current selling price on a gift card. Worth asking and much better than throwing it in the bin.

Just so you know you do not need to have a receipt to return stuff by LAW. If people say they wont do it, have yourself a quick look at the sale of goods act and a little consumer law - you'd be surprised how quickly people want to help you when you start quoting from these

But you do need to be able to prove where it was purchased from.
This item was in a box with the argos code on so it was obvious.
If it was a toy which was sold in many different stores then the buyer would have to be able to prove it was purchased from that store otherwise the store would not be obliged to do anything.Sometimes it's important to work for that pot of gold...But other times it's essential to take time off and to make sure that your most important decision in the day simply consists of choosing which color to slide down on the rainbow...0 -

If you look down the page on the dti factsheet for the sale of goods act it does state that:
"However, it might not be unreasonable for the shop to want some proof of purchase, so look to see if you have a cheque stub, bank statement, credit card slip etc., and this should be sufficient."
I'd like to see someone try and return a asda baked beans to tesco and say "I don't need a reciept by law" LOL
