Dmp/Iva - can we reclaim any charges

Hi all
Not sure if this is the correct place to ask
Has anybody tried to reclaim charges on loans, credit cards etc, whilst on a dmp or iva
Has anyone been successful

Hi there.;)
Yes you can to what I know of, it makes no difference at all, I'm also on a payment plan due to hardship and reclaiming mis selling of payment protection insurance, then on to the charges.
However, I've not a clue with helping on this side of things with charges, only that of PPI, but sure someone here, maybe natweststaffmember who knows his stuff will post up with some help for you in regards of the charges, you can do this by hardship with your circumstances.

If you're in an IVA, then you are allowed to reclaim charges (because they should not have been included in the IVA by the creditor (they are receiving an unfair proportion of the IVA dividend). However, the money you receive back is treated as a "windfall" payment and your IVA will probably have a condition in it about what you must do with the money (most probably it will say "all windfall payments must be paid to the IVA Supervisor for distribution to all the creditors).
I'd check with your IP/IS to confirm this ... you could even ask them to reclaim the charges for you (it's what they're being paid for after all).
I don't know about DMPs.
FYI - I had an IVA that I was very lucky to settle early ... So I reclaimed charges after the IVA had completed ... and in that case ... the money all came to me!:AIgnorance can be cured, but stupid is forever!:A
