Hi Everyone
I am trying to find the letter to tell creditors to contact via mail rather than phone
Capital One just called another branch of my company and got them to transfer to me
My boss and everyone was standing in the office and I couldnt speak so hung up and guess what they called straight back. I'm horrified
The guy on the phone even threatened to call friends and family to try and get hold of me (which i have no idea how they would manage that they don't have the numbers so assume its a scare tactic)
Capital One are complete bullies and informed me that he had removed my work number from the system, but if i failed to answer my mobile then it would redial to my work......that doesnt sound like removing it to me!
I'm horrified as i really want to keep this seperate from my work as my work does not need to know about BR

Well they are breaking several laws there already. If they call again ask the chap his name and say to him 'just to warn you I am recording this call and shall be making a complaint to Trading Standards and the Office of Fair Trading'. See how quickly he puts the phone down

There are a lot of different response letters for harassment by telephone floating around. This is just one example:

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Send it registered post.

I had thought that they were breaking a few rules but when caught off gaurd like that i couldnt think.
I told him that I have already requested all contact via letter and they told me that cant happen as every month i don't pay it gets passed back to the collections dept and they don't have to accept a letter.
So i will be sending this one recorded and tell them i am recording it

What I did was I changed all my numbers including my Mobile, and any that do get thru' and its easy to find a persons number( if you pay for a phone bill you have a bank account you can be found Big Bro is very much alive) Ask for that persons name and line managers name , tell them the call is being recorded and that you intend to pass all this info to your solicitor, it works very well . Another trick I enjoy is when they ask you to go thru all the security checks is Answer them wrong you can hear the disappointment in their voice when they tell you that you have failed the security check and they cant talk to you any longer 'Gutted' and my favourite is to tell them that I am Jo Bloggs solicitor for John Smith my client may I have your details please ? the line usually goes dead at that point. Also don't hang up when they go as it ties their line up as long as you have yours open.
None of this solves the problem but it makes you feel a little better0 -
Far be it from me to be scathing at what people have to do to earn a crust - after all I didn't have enough crusts to pay the bills - but can this sort of harrassment job be anyone's career of choice??

Mustbedebtfree, if they phone after you know they have recieved the letter then make sure you quote this bit at them after you have got their name and their line managers name. Make sure you log the call and names and after several calls report them.

Thanks for the great advise. BUT.................... I have recieved this response
" Thank you for writing to us about your Capital One Account. I understand that you are unhappy with the calls from our collections department.
To explain, our collections dept are calling because you are behind (i have shortened this bit)
If your account is kept up to date then they will not call.
If your account is not up to date, we do not feel it is unreasonable to contact you.
To prevent future calls you need to bring your account up to date.
I understand that it is not appropriate for you to receive calls on your work number. We don't have this number on file however, if you write back to me with your work telephone number i will ensure this is removed from our automatic dialler.
I also understand that you want us to contact you in writing only. However we will not be honouring this request. We can review this decision if you can provide us with a valid reason for stopping these calls, other than not wanting to be called."
Now i have no idea what to respond to that. I'm sick with worry
They technically don't have any numbers to contact me on because my mobile contract got cancelled and my house number is ex directory. so they knew where i worked and basically called one of the receptions from another facility. I don't want everyone in my company knowing what my situation is

You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

Espically since my debt with them is so small. I have debt 10 times the size with other companies and they just send me a letter occasionally.
