Powerseller mucking me around

Bought some straightening irons from a powerseller as xmas pressie for my mum. They were sent by courier and arrived within 24 hours, so was chuffed and left positive feedback. Just about to wrap them up but decided to test them to be on safe side. They didn't work!
Emailed seller 3 times before getting a one line email saying return them and we'll replace.
Sent them back recorded delivery costing me £4 in p&p and know that they were signed for last tuesday as have checked the royal mail website tracing service. Have emailed time and time again since then chasing plus left a message on answerphone (nobody answers the contact number!).
Finally got another one line reply from them today telling me that their courier has delivered the item (ie the original faulty item) a fact I'm not disputing. The reply includes the text of my original email which sets out all the facts.

Can anyone please offer any advice? I've emailed again stating all the facts with dates etc (sent to every address I can find) and I've asked for my expenses to be reimbursed and for the replacement to be couriered to arrive before xmas. I just feel like I'm wasting my time as it seems that they are totally incapable of dealing with emails that aren't in respect of a sale.
Gutted I left +ve feedback now, but I guess I can't do much apart from leave a follow up comment - but my feedback is now 3 pages in, so not many people will see it. The rest of their feedback is glowing on the mostpart, but I've subsequently found that any negs they do get refer to unanswered emails - I would expect better from a powerseller.

This may help - send one more email - and advise them you have informed both the DTI in respect of their sale of faulty goods, refusal to respond and the fact they have now pocketed your money and you have no goods. Tell them It is an offense under the Sels of Goods Act1979 to sell itemsnot fit for the use intended etc
Then threaten them with contacting the local tax man! this does it every time because not all ebayers are aware you do actually have to declare income made when you asre trading in this way.
There is also Square Trade - youll find it in the ebay help section - contact them
To be honest the tax man and DTI threat have been enough in the past for me to have a reasonable response from a dodgy ebayer.
Powerseller status just means they have to have an income per month of X - doesnt mean they offer a good service but i bet they wouldnt want to be stripped of it - try emailing ebay.

I will give them a little more time to respond to my email of this morning which summarises everything before I start making threats - just in case it is just a big cockup - not sure what constitutes a reasonable timescale for the situation to be rectified though - any suggestions?0 -
how did you pay?
if it was by paypal, start a refund process (as long as it is in the first 30 days)smile --- it makes people wonder what you are up to....

Yes, it was by paypal. Wasn't sure if I fitted into the category of not having received the item which is what they specify :-/
I suppose I haven't received a working item anyway, plus I've returned it so its no longer in my possession either.0 -
better to start the process, then cancel it, than wait and find you have missed the 30 day deadline ....smile --- it makes people wonder what you are up to....

What is considered a reasonable amount of time for something like this? Am I jumping the gun by wanting it resolved within a week of them receving the faulty item back? Suppose I'm being more impatient than would usually be the case as its a xmas present.0

I know what you mean about jumping the gun but it was meant as a xmas present and surely the seller should understand that and at least send you a courtesy email even if they cant get a replacement to you before xmas.
I have a handbag shop on ebay and im a powerseller and a seller its the speed of delivery, willingness to refund/replace and of course the quality of the item and price which makes the shop so successful. If the seller has usual good feedback for this type of item then perhaps they are just snowed under but you need to look after yourself and perhaps start the paypal refund process mentioned earlier.

Thanks Technonerd - exactly right, it wouldn't be so bad if they at least acknowledged that they understand the situation and are doing their best to rectify. But I'm either ignored or get a terse one liner - not a whisper of an apology. Its just plain annoying.
I will give it until tomorrow morning and then will initiate the refund process.0 -
Surprise surprise, haven't heard anything whatsoever from him - I see he's got a new neg today that says he doesn't respond to emails. Can I report him for false contact details given he doesn't reply to emails and the phone number just goes to voicemail?
How does the refund process work? The seller could prove that he sent the item to me - do I have to prove that the item was faulty and sent back? I've got emails etc and I have a recorded delivery slip and postage reference number - is that sufficient? When you read the paypal stuff it says that you can seek a refund if you don't receive goods, but i don't strictly speaking fall into that category :-/

I bought a Hello Kitty wallet for my little sister's birthday in October. Paid promptly by PayPal. Received the wallet promptly too, BUT the wallet is so discoloured(probably left in the sun by the window or something), and dirty with marks inside and out, and don't look new at all as described.
I emailed seller, seller said return & they will send another one.
I posted it back, 2 weeks on didn't hear anything. Emailed seller, seller asked for item no. etc, I give, seller said didn't get anything.
Another week, another couple of emails, still said no didn't get anything.
In the end I said, LOOK, you sent me faulty item, I returned as agreed, even if it didn't arrive, can't you at least refund my money as you sent a faulty item in the 1st place & I'm losing money paying for something tht's faulty & lost money on posting it back too! Seller said, no goods, no return.
I complained to ebay. Which the seller got a copy of. Immediately after complaint, got email from seller saying "we did deliver goods, so you have no right to complain. we will supply ALL your thread of emails to ebay." Nothing was mentioned about the goods he DELIVERED being faulty at all!
Surprise surprise, ebay never replied to my complain.
Finally, I left negative feedback for seller yesterday. I've never left any negative feedback before. But I'm so disappointed as the present was meant for my little sister & not only she didn't get it, I had to get her something else that wasn't what she wanted.
My advice, don't expect ebay will help you. I've had a few disputes, they never helped. Instead provided links and links and more links. If you want to buy something, check the feedback first. The negatives - check what they are about. If non comms, late delivery, goods not as described, don't bother bidding/buying.
Don't mistake these bad ones with the decent sellers that got retaliation feedback though.
My problem with the Hello Kitty wallet was I was in a hurry, and it was the only wallet available on ebay that my sister liked, & it's cheap within my budget. So sod the feedback, I just bought it. Big mistake.
