Vodafone upgrade been mis-sold?

Hi all,
Bit of advice required

Have been due an upgrade with Vodafone for the past month or so, they wernt playing ball in stores or with normal upgrade options so I sent in my 30 notice letter which they recieved and called asking what they could do to get me to stay.

At the same time I have an upgrade due with 3, who when i said I would also leave came out with 500 mins, unlimited text and umlimited mobile net for £25 month 18 month with free LG Renoir. Very good I thought lets see if Voda can do anything as I want the Tocco Ultra.

They said they would do all they could once the handset came into stock and they knew exact prices, fair enough I thought they take note and promise to call me when the phone is in stock.

Thursday comes (26th) and I get a call from Voda, phone is in hurray.

Lady on the phone says what would you need to stay and I said what 3 had offered and she said will you stay if I do the same with 600 mins and everything else the same plus Tocco Ultra not Renoir. I said yes, so we went through the details and I got her to confirm more than once that the price was for 18 months and internet included. She said yes more than once. I was happy with that and delivery was due yesterday but didnt come as there was a confusion with upgrade and termination notes both being on my account.

A very nice advisor who I believe was in Scotland has today sorted that all out for me and arranged delivery for Tuesday which is great and then gos through the normal spiel of a months free insurance and mobile net, WAIT only a month free net? Yes she says that is normal, after 1 month I have to pay £5 a month for it bringing line rental to £30 and not £25 that was agreed.

I told her my story and she says that whoever has done my upgrade has already used more than the discount allowed on my deal and internet is never included and they have no way of adding it on, she was very helpful throughout so I thought its not her issue to have to deal with she didnt say it.

So my question is, if they record the calls as they say they do and I know I was told the internet was included throughout (my main concern was that it would turn out to be 24 month contract, but it is 18 phew) do I have grounds to claim I have been mis-sold the upgrade? I know I have the 14 return policy but I would rather they sorted this out and gave me what I was promised.

Is my next step to phone them back and ask for answers or should

I write to the CS and makes threats that Ive been mis-sold and say they need to provide call recording to prove otherwise?

PS Snoopy id get on the phone mate and check yours is not the same or you might not notice you are paying £30 a month until after the 14 return has passed :p

    You don't have 14 days cooling off for an upgrade unless the retailer (Vodafone in this case) offer it as part of their customer service policies.

    But, yes, it has been missold and I would get googling for a phone number of someone higher up than normal call centre workers.

    Called them back and they tried to say something about at £25 I would have to pay £200 odd for the phone normally but they are doing it free, I said if that was what was said then fair enough but it wasnt, a few minutes later and issue is resolved with a manual 100% discount on my account for the £5 of internet charges success :D

    Have to say I do think Vodafone do have good intent most of the time, they obviously appreciate that its not worth the bad worth of mouth created when its clearly an argument thry couldnt defend if the call recordings were bought up/

    Hi ssgtsnelly.

    When I phoned for my Ultra, he asked if I wanted 1 month free internet.... I replied saying I thought that internet was included in my plan. He said it is, so you get your first month for £20.

    Will check out the paperwork on Tues when the phone arrives. Thanks for the warning!

    Went into the Voda shop today to have a look at it. Seems a bit bigger than I thought it would be, but I'm sure I'll get used to it!

    hmm seems like they are telling us all different things haha, im expecting it to be fairly big based on the screen size but in a way that is good as i will be able to play tv and movies on it with the divx playback, just need to source a large memory card now :)

    I've had renewal problems with Vodafone in the past very similar to this, they say they record calls, but 'can never find the recordings' when I've called them on it (I think they must keep recordings, but pretend they don't when they know they count against them) - so far everytime when I've held firm they have backed down and agreed to what was originally offered.
    Its worth contacting their FIT team (contact us on website include FIT135 in title), as I have found them to be more helpful and capable than std customer services in the past.

    Got my Ultra today and got it on charge, as snoopy said it is bigger than it looks but its very slim and the screen is nice and responsive, once ive had a good play will update
