Income support - incapacity benefit question ????

My girlfriend has epilepsy always having constant fits it is not under control so she can’t work or drive, I am thinking of starting my own business.

I don’t know how much I will be making but If I exceeds 200 pounds will she be entitled to anything other than what she would get, dla 50 pound a week, for example income support or incapacity

  • If she currently gets I/B that wont be affected by your earnings,income support(assuming you live together as a couple)would stop,dla is means tested and wont be affected in any way
  • She is already claiming income support and has for the last 2 1/2 years.

    She first received this with a doctor’s note but now only fills the forms in every year.

    She is awarded Dla £50 and has to fill the form in every 3 years.

    She is 21 now and has had epilepsy since 13 with dla starting at 15.

    How would she move over to incapacity benefit if she is on income support?

    Also someone mention the new system how would that affect her.

    We live together.

    If she had to provide a doctors note for Income Support I would wager that she is already on Incapacity and that it was actually them she needed it for. Income Support cant pay people solely on the basis of a med cert. They need the IB claim to have been made. DLA isnt a qualifying condition for IS.
  • Yes but she was moved from incapacity to income support, I think it was because she has never had a job so no NI contributions.

    Unless she gets them while on income support she still won't have any.

    What could see do if she still needs NI contributions for incapacity or does she after 2 1/2 years????


    Also on another note if she 100% can’t get anything would they help her back into work?

    She would need a safe job + 24 hr carer in case she has a fit, also if she has a fit she would need an understanding employer.

    I personally can’t see anyone accepting this unless it is a support to work place like new deal but then to pay her national minimum wage + 24hr carer it would cost them more, so like above there must be something she is entitled to.

    Are you only just moving in with her?

    What source of income have you been receiving until now?

    Why should she be entitled to benefits when you are earning to support her? :confused:

    She would have been entitled to IB under the Young Persons Rules - she wouldn't have needed any NI contributions. It sounds as if you need a good advisor to look at her case - the history of it as well as the current situation.

    What I don’t get is if I got a job I would get £171 – travel £150 so we would be worse off by £50.

    If she still get’s Dla it would be around the same money – minus a carer for her.

    I know I want get cares or she want get income support, she doesn’t have enough NI for Incapacity.


    It seems quite bad as 2 people working national minimum wages get £350, so we would be worse off with one having a disability????

    Are there any schemes that get disabled people back into work like a normal job but with a carer while she is there?

  • I am certain that Jobcentres have people who specifically help disabled people back into work and help with all the issues surrounding it. Would they be called a Disability Advisor? (Sorry, I'm not 100% sure....)

    Edited to add:

    There is a programme called "Choices" which is run jointly with the NHS and Jobcentres, this is a quote from the leaflet -

    "If you want help to return to work now or in the future, you need to know what services we can offer and what your choices are. These choices include
    - extra money to help when you start work
    - new programmes run with your local NHS to help you understand and better manage your condition or disability
    - information about work that you might be able to do without losing your benefit"

    It says to ask at your Jobcentre.
