Hi, I'm new to this and could really do with some help advise.
My OH and I are going to file for bankruptcy and at the moment are saving up to do it. We were going down the IVA route but had it turned down as our creditors did not feel that we could pay off enough of the debt, we were very surprised as over the 5 years we would have paid off about 45ish%, and now feel that bankruptcy is our only option.
We tried to do everything to reduce our outgoings, we tried to sell our house, which fell through at the last moment and so had a voluntary reposession from northern rock, we moved closer to my OH work to cut down transport costs and are now renting in a cheaper area.
In total we owe about £100K, this includes a together part of our mortgage from NR of £25K, a secured now unsecured loan from endevor of about £20K after £15K was paid of from house sale, about £20K from GE for windows and heating/electric and the rest in loans and credit cards.
My OH works ft and has a good income now but was self employed and on short contracts in 06/07 and we borrowed money and used cards for the time he wasn't working or between jobs also he wasn't paid for 3 months last year which meant we ended up putting day to day living on cards until the pay came through and we couldn't catch up which was why we put the house up for sale. Not that any of this is an excuse but I'm just trying to explain how we got here.
I'm a SAHM we had a baby at the begin of 06 and I realised that it would be about the same cost to put her in nursery and work than stay at home. I'm also going to have a baby in 5 weeks which also changes things.
At the moment I've spoken to CAB and the IVA company we were with and I'm slowly filling out the forms on line but as our family will increase soon, is it best to wait until the baby is born and we sort out child benefit and tax credit before we file? We also need to get a court date, we live in east london, does anyone know if its a central london court or if each borough has one? if there is just one does anyone have any idea about how long the waiting list is?
Sorry for the long ramble:o , i've probably got more questions which i'll post when they come up.
thanks

Hi and welcome to the board.
Congratulations on the immenant birth of your baby . That's lovely news. When is the baby due?
If you go to the High Court in London then it is a walk in service. You just turn up on the day. There was a thread about it earlier, will go and find it for you. Here we go, this thread has some links in it for people who have gone BR in the High Court.

Just wanted to say hi and welcome before i go to bed. This place is a godsend for those in your situation. We or most of us have either gone or are going bc so any questions fire away. It keeps us out of trouble;) . It is not as bad as you first imagine but you have to get there and look back before you realise that. thanks for that. baby due on 14th november.
anyone have any idea how long it takes creditors to start chasing you again once an IVA was turned down?BR as of 16th March 2009Ready to start a new chapter in my life:j0 -
Entirely up you but it may be easier to do this before the baby is born as I am sure you don't want to be pushing a new born round the courts. Then when the baby is born and you have sorted the new CB and CTC then tell the OR your circumstances have changed. Others may have a different idea.
As for the creditorsHow long is a piece of string
