I have an egg money credit card and i have had to claim three times from them. They were amazingly easy to deal with.
The first time i had brought some clothes from an online sports site with a total cost of about £5. the site had said it was delivered and i said it wasn't three months and no joy so phoned up egg and immediately credited account as it was below threshold.
The second time was for a medival festival that went bust, the transaction was for £11. Phoned egg to inform them that the company had gone in administration and recieved an immediate refund.
The third time was for the same festival but this time i was for two tickets (£25). All i had to do was fill in form and send in emails recieved from the company and the tickets and recieved a refund in less than three days.
My point is that even if the amount is under £100 give your card company a call and they might be able to sort it out for you without loads of fuss.
worth a go.

That's good to know that you got your refund for anything under £100.
I just wish I was so lucky and mine is well over £100.
After reading what Martin said there is a loophole in the Consumer Credit Act in that if you paid a third party then the credit card is not responsible.
My problem is that I paid a travel agent for a package holiday with XL on my credit card. The cc are referring me back to the travel agent for a refund.
But I thought I was covered under the CCA. Is this the case?
I READ ARTICLE WHICH STATES YOU ARE NOT COVERED BY SECT 75 OF CONSUMER CREDIT ACT IF YOU PAY FOR PRODUCT VIA THIRD PARTY IE PAYPAL. I HAVE CONTACTED NATIONWIDE CREDIT CARD AND THEY STATE I AM COVERED.
Hi
I applied to Abbey for chargeback for a refund after XL's collapse, and completed their forms. They have now written back saying I have to claim through ATOL, ABTA or CAA. Whjat a waste of time!!
Can I write back and say they have to give refund? ATOL will take ages it seems.

Agency payments are exempt, so paying through paypal is generally seen to be exempt. Do remember callcentre operators tend not to be briefed on the minutae of section 75 (if they've even heard of it)
If Nationwide are saying this, and its a big purchase, ask for it in writing, or record the phone call (letting them know you are doing so) as otherwise I wouldn't rely on it too heavily.

What's the best way to pay a travel agent for a holiday if they are "Retail Agents for ATOL holders"?
Under Section 75 of Consumer Credit Act it says that the Credit Card company have joint liability for claims over £100 and under £30,000. If an item is over £30,000 is it not possible to claim or is that a maximum one can claim?
Hi there, I bought jewellery whislt abroad and found out upon my return the gem was not correct therefore the value had halved. Attempted to speak with them but they won't respond. Can I claim under this act?? Sarah x

Why is this article headed "Free protection for ALL spending"?
If the protection is for ALL spending, how do I get it if the item costs less than £100, more than £30,000, the seller won't accept a credit card, or I pay an agent? Am I missing something, or is the heading simply misleading?

I also bought jewellry in Dubai and after about 6 months one of the stones crumbled away. I contacted the shop several times with no response. I contacted the Dubai Chamber of Commerce who originally said they would assist but then refused to reply to e-mails after I had sent them copies of the receipt.
I paid with a Morgan Stanley CC, and when I contacted them they said that I couldn't claim through them. Now, as I understand it, under section 75 they should have refunded me. Now they have been taken over by Barclaycard, so can I claim through them (the purchase was June 2006)?
I bought a sony vaio laptop computer in november 2007 using my company credit card issued by HSBC bank. I bought it over the internet and the company who sold it to me has now gone bust. More recently i have had increasing problems with the microsoft office software that came loaded on the laptop, included in the sale price. I have gone to microsoft website to get the relevant updates to fix the problems but microsoft tell me that the software on my computer is a fraudulent copy and wont therefore give me the updates i needto fix the problems. As the web company who sold me the laptop has gone bust i can't claim against them so i contacted HSBC to make a claim. They said in their reply that there was nothing they could do.
is this right or do i have a claim under Section 75 in this circumstances?
I am in the process of claiming compensation from Barclaycard as a result of Zoom going bust and leaving my wife stranded in Canada. I wrote a very clear letter to them telling them I was making a Section 75 claim against them, and not Zoom. They have now written back asking me to contact Zoom/liquidators and inform them of their reply.
What should I do?
Should I just write back and remind them my claim is directly against them?
The letter didn't even say what to ask of Zoom/Liquidators, just to speak to them and pass on what they say.
Please help...I thought Section 75 allowed one to press a claim directly against the card provider.
I have an egg money credit card and i have had to claim three times from them. They were amazingly easy to deal with.
I also have an Egg Money card and I've been having a nightmare of a job making a Section 75 claim for goods, costing over £200, which were never supplied by a retailer.
The letter I've had from them states that because the retailer is still trading, it is not their place to provide a refund - stating "s75 does not entitle you to an automatic refund".
FOS here we come.

Help! I recently had a delivery of heating oil (over £400) and the company damaged an oil pipe during a shoddy delivery. Concern was expressed the next day when I reported it to them but they have since ignored me including correspondence. I wrote to MINT asking them to reverse the transaction and have just had back the standard reply 'they have no direct contact with individual retailers........unable to assist where the standard of service is in dispute'.
There has clearly been a breach of contract here (confirmed by Trading Standards) so how do I best approach this? Should I be insisting on a partial refund to cover the damage as I can't give the oil back or do I go for the full refund until the retailer reacts?

I bought built in wardrobes from MFI for over a thousand pounds and they were due to be delivered next Friday on the 5th December. I've just heard that MFI have gone bust ! Anyone advise what I should do now?
I paid with my American Express Card so I hope that I'm covered under section 75 although I don't really understand exactly what this means? There's no answer from my local store - they are probably avoiding all calls at present. Should I contact American Express? I'm very confused and very worried as I definitely can't afford to lose this sort of money. It was supposed to be the main xmas present for my daughter to have her own new bedroom. I don't know how I'm going to tell her
Any advice really appreciated guys. It makes you feel so insecure - I hear Woolworths has gone down too? I don't think I want to buy anything again unless I can take it away there and then.

Don't panic - they're going in to administration, not liquidation, and according to the BBC: "Some stores will continue to trade, but 26 will close. Existing orders will be either met or refunded", MFI said.
Thank you so much for trying to calm me down.
I do feel a little less panicked now I've had some time to think. But I'm still a little worried as I read that the company that MFI use for their deliveries have also gone bust and that is why some customers haven't had their goods. Hopefully I will get my money back either from MFI or the credit card company but I am not hopeful of getting my wardrobes and I'll never find the same wardrobes as cheap as I did.
And even if I get my money back I have no idea how long it will take to do this. Anyway, I don't feel quite as bad as I did so thank you so much for your advice. This will certainly make me very much more cautious now.
Hi, I bought a new bed and wardrobes from MFI only two saturdays ago. I heard the bad news today and tried to phone MFI - no answer either! I then phoned my Halifax credit card who I luckily paid with, and they said straight away they would cover my costs and are sending me out a form to get my money back! Am nervous but hopeful it will all work out ok.
ps, when I phoned my same credit card company in june 08 because my flight was cancelled they said I could not claim money back on my credit card for flights as flights were exempt. Is that right because it doesnt seem so by what i've read about section 75? That was over a grand!!
