As far as I'm aware the DPA does not require the holders of this type of information to register, given that the information is only held for a short time and is for only one purpose and not held on a database. (whether electronic or not). One may also find that when purchasing items the CC company or agent will state in it's own Ts and Cs that the purchaser accepts that certain information will be held, thus negating some rights under the DPA. Therefore the DPA avenue of complaint may end up in a blind alley. Whether this is right or wrong, fair or immoral is not an issue for the parties in the transaction unless a court higher than that that passed the statute judges differently.

Now, my knowledge in this area is historic and may be incorrect now but that aside it may be worth noting that as far as I am aware *very* few successful prosecutions have been secured under the DPA and that the agency underpinning it has had continual and severe systemic failings of it's own, making it pretty impotent in it's role as required by statute. This is opinion only and input from any legal beagles out there who could corroborate or refute this would be welcome.

Hi, I'm a new poster but find this kind of thing fascinating how people really believe they can get away with a con like this. In a world where we are supposed to be protected by laws and acts, its incredible how things are still very unclear - all financial institutions should surely give the same answer but this doesn't seem to be the case from reading peoples comments on here after they have spoken to credit card companies etc. Surely this should be a tried and tested process by now.

Anyway, my reason for the post - from the T&C's I read:

"To the maximum extent permitted by law, neither we nor any of our directors, employees or other representatives will be liable for any of the following losses or damage (howsoever arising and whether such losses were foreseeable or not):
    loss of data;"

Correct me if I'm wrong but that contravenes the Data Protection Act? If they are asking for multiple forms of ID upon arriving then I guess they are logging this somehow and they are responsible for protecting YOUR data. And therefore, if they then 'lose' this data (possibly sell it to known ID fraud gangs - but you'd never prove this) then according to their T&C's there is no comeback on Lapland West Midlands yet your ID has been sold on.

I really hope this kind of con highlights the need for everyone to read the T&C's before ever typing your details into a website especially when making purchases - this threat needs to be made clear to the public as Internet EComerce is still in its infancy and we have a chance to put the system right now.

Thanks for reading and good luck to everyone who is fighting for reimbursement.

I'm sorry to mention this but I take one paragraph from the latest message from the proprietor on the Lapland New Forest Ltd website just to illustrate what is being dealt with here.

I am currently endeavouring to find solution to this situation, including gathering finances from other sources in attempt to first reimburse the many charities of under-privileged children who were to be our special guests.

Why would anyone reimburse charities in respect of under priveleged children who were to be special guests ? Were they being charged ?

    Incredible.

Sorry pardon - I had saved the web page

  • I see they have now lost the reference to the 'favourite characters on ice' and now changed to 'favourite characters on show'

  • I have extrapolated using Google Maps and I predict that Lapland Leeds will be open next weekend! The domain hasn't been registered yet but there's still time!

I'm absolutely stunned that people are paying £85 for the laplandUK place! I'm seriously tempted to set up a lapland of my own next year if people are shelling out this kind of money. I reckon the Dorset and West Mids events are being run by different people, but they do know each other, and they probably saw that people were prepared to pay these insane prices and over a couple of pints one night, hatched their two scams together, hence the similarities.

What their parents may not know is the reindeer aren't coming, the huskies are in fact a "similar looking" breed of dog and, in a last minute change of plan, the ice rink has been replaced with "a rollerskating platform". Trading standards officers who will attend the opening, said yesterday they had "serious concerns"............ ................................
    .............................
The avalanche of negative publicity surrounding Lapland New Forest, in Dorset, has had an impact for the West Midlands version. Chris Daley, the site organiser, said many of his entertainers had been "spooked" by tales of distraught children at the Dorset park, and cancelled their participation.
"They've seen what's happened to the other guys and said: 'We're having nothing to do with it'," he said. "The reindeer aren't ready for the opening day. A fellow was going to bring some of those white snow dogs. They're not huskies, but to look at them you'd think they were. Now he's saying he doesn't want to get sued for calling it a husky. So now we're after more dogs."

However, the ice- skating rink has already been cancelled and there is no sign of the racing track, the bungee trampolining, the climbing wall or the Formula One race track advertised on its website.
All that could be seen at the park yesterday 24 hours before its opening were ten small white marquees, shabby Christmas trees, tacky spotlights and a few solitary workmen laying sawdust paving in the field.

  • LAPLAND WEST MIDLANDS WARNING:

"Families are being urged to "think carefully" before buying tickets to a new Christmas Lapland attraction.Staffordshire County Council said it had "serious concerns" about the Lapland West Midlands event in Essington, near Wolverhampton, which has not been granted permission to open.
On its website, Lapland West Midlands promises an "authentic taste of Christmas" complete with reindeer and husky dogs, ice skating and "real snow every hour" - all for £25.
But council chiefs expressed concern about the organiser's ability to deliver everything advertised.
A statement published on the council's website also expressed concern that Lapland West Midlands does not have a permit for the reindeer and dogs and that the location is unsuitable for traffic.
Carol Dean, Staffordshire County Council's cabinet member for safer and stronger communities, said: "We are extremely concerned about this event.
"We are monitoring the situation and will have officers on-hand to check the site and advise the public."
There was no answer from Lapland West Midlands when telephoned by reporters.
A message on their website stressed the company was "nothing to do with" Lapland New Forest, which was the focus a storm of controversy before closing down earlier this week."
    (PRESS ASSOCIATION REPORT)
  • The lapland westmidlands website states "all under the cover of decorative marquees"...

Elsewhere it tells you to "bring your wellies" because they have had "heavy rain".

If it's ALL under cover as they say, why the need to bring wellies...?

    Someone isn't telling the truth...

THINK VERY CAREFULLY BEFORE BOOKING FOR THIS EVENT. A fool and his money are soon parted, as the old adage says..
