I have helped a friend and my sister with this and both havent been able to produce CCA and have had their debts written off with letters from the DCA's stating this.

I believe Penny Pincher is correct , reading the C C Act , they are braking the law if they do not comply in the set time . The act also states that they are not allow to act on the account (sell on ) before the imformation has been supplied .0

I want to ask for these from a couple of DCA's I am paying...... can anyone point me in the right direction for a template letter please? Ive searched but I cant find anything really relevant.

hi , i emailed cccs.co.uk and the nice people emailed a template letter . Make sure you do not sign letter and send recorded delivery and check date of reciept. good luck0

What happens if they do actually send you a copy within the time allowed? I keep seeing threads where people haven't had the paperwork back & had it written off but never seen one where they got it in time.Winnings

Providing that they send you a 'true copy of the original signed cca' which contains all information that the cca must legally contain, then that cca is enforceable. There are instances of this occuring on this forum.
The fact that the cca is enforceable does not mean that the 'debtor' can not negociate a payment plan, or that the creditor can, legally, harrass the debtor.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

It only costs a couple of quid to do ,so well worth it ! I,m sure some of these companies have lost the paperwork . Would they not just take us all to court ? Plus they will have purchased the debt for a faction of the orginal amount ,so anything they get back for afew letters and phone calls is a bonus.0

I totally agree, stapeley. It is a 'couple of quid' well spent. If the creditor or DCA does not provide the information within the legally allowed time frame, then, whatever happens, that 'debt' can only be enforced if the creditor/dca applies to the courts for an order, which is unlikely to be granted once the 'debtor' informs the court that he/she requested the cca and it was not supplied within the time frame.
Even if the creditor/dcadoes come up with a true copy of the original signed cca within the legally allowed time frame, this can also show if the 'debt' is statute barred. At the very least, the 'debtor' will be better equipped to 'deal with the alleged debt'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I asked for CCAs from 4 banks and only one was able to supply an agreement within the requirement time period. The remainder followed shortly thereafter, but it did reveal some inconsistency with the charges that I'd been getting; one has been written in someone else's writing (which I've got serious issues with!); one revealed that PPI was originally signed for 1 yr only (so I've asked for premiums back after that period expired); and the final one was not a CCA at all.
What these requests did buy me was a little bit of time as all parties froze interest and charges until such time as agreements were located. I'm not looking to get out of meeting my commitments, but becoming moneyaware has led me to question the agreement originally taken out and to ascertain whether the banks have stuck to those original terms and conditions.Almost debt-free, but certainly even with the Banks!0
