From the threads I have read on here and other web sites, defaults on mobile phone bills are simply passed onto debit collectors if the bills are not paid. They only need to send you the bills.
The debit collectors have 6 years (I think) to chase up payment whilst screwing up credit history along with that. The mobile company can wash their hands of it affectively.0 -
O2 have confirmed that no 3rd party is involved. They still own the debt, it was never passed to a DCA

EDIT: O2 claim that £630 was added to the balance due to an early upgrade ordered before the end of the initial 18 month term. They claim a Sony Erricsson K800i was sent out and they traced the IMEI number for use and confirmed that it had been used.
I was given a default in 2004 by 02 for the sum of £65 claiming that a new contract was started and a phone sent out to me... exactly the same circumstances as you, they claim a default notice was sent and that they traced the IMEI number for use and confirmed that it had been used... but I had NEVER seen this phone let alone had a contract with O2 at the time!
I have written to them many time contesting this and got no-where so good luck!If you don't want to know my opinion, don't ask for it!0 -

No, they won't. They have not passed it to a DCA despite non payment for two and a half years, and they just last month accepted £20 a month to settle the balance, which is being paid, whilst I establish who owes who what, and we'll continue paying the £20 a month whilst the issues are being looked into as to how much the default notice should have been for and whether or not it should have been recorded in the first place.
I'm also going to SAR Three, who sent a default notice years and years ago, I rectified the problem within the timeframe they provided on the DN, and no default was recorded on my credit report. So I can show O2 what Three do, and say well you didn't, so up yours sort of thing. OTELO want to start getting their guys involved with O2 right away, but I've told them to hold off until I've recieved the SAR data and offered O2 a reduced F&FS in return for removal of the DN. If they won't comply then OTELO will have at them

Hang on. O2 admit that ' fraud probably has taken place ' but still expect you to pay for it?
I'm going out on a limb here, but I work as a fraud investigator with one of the other networks, and that sounds very wrong (but without all the acc info its hard obviously).
What are they doing to look into it?
How long ago was it?
Are you sure you spoke to the fraud dept? As some networks fraud teams aren't 'customer facing' (I hate that term)...0 -

This is the thing, she conceeded that fraud has probably taken place and advised that still we are liable for the bills incurred as a result.
HOWEVER in the two and a half years of the account being in default O2 have never asked for any money, chased the debt, or passed it to a debt collection agency.
If my goal was not paying then it wouln't be an issue; that's not my goal. My goal is having the default notice removed.
I said to her that we can prove that we weren't living at that address by way of a council tax bill from another county covering the tax year that the "Upgrade" handset was delivered to the old address, she said that's nice but your still liable.
I don't mind the liability for call charges, because the SIM was left at the old address without a PIN, but liability for them taking an upgrade order from someone other than the account holder?
We comply with the data protection act because we ask for three pieces of information she said, even though I got through to her by providing only two thing - phone number and password, which incedentally was the pets name. One of their suggested questions. Bloody stupid question when the pet is in a shared house!
She even admitted that the IMEI of the "Upgrade" handset had a PAYG sim used in it, which was registered to someone else, after they disconnected the contract SIM.
Absolutely shocking that they don't want to investigate further. As far as they are concern it's an open and shut case. Yes there was fraud, no they aren't liable. That's their stance.
I've even quoted the distance selling act in that any alleged agreement to contract must be held in a durable format for it to be enforcable, by way of a call recording, signed agreement paper, or digital signiature. She conceeded that they don't hold this evidence which is likely why they haven't enforced the debt through a debt collection agency, but she said the default notice still stands because you used the upgrade handset. Forgetting that earlier in the conversation I offered up evidence that I was living somewhere else the date the handset was delivered. But if it is fraud it is their problem, you cant be held liable for something you didn't agree to or know about. Get in touch with trading standards in the morning and even potentially check your local newspaper to see if you have any free solicitor advice days/sessions. If she says that they won't look at it because it's 2 and half years old, I can sort of see what she means.
Most fraud is found out with the first few weeks and gets investigated. After over 2 years (purely from the networks point of view) it looks a bit iffy. BUT the way we work it is to asked the customer for a written disclaimer stating all the facts and signed and dated and we'll then look into it for them. But I don't work for O2.
I'd say you need to call them again and ask what action they can take...0 -

My problem is a similar one,
How do I get a default (that is false) removed?
Solicitor wants £230 in the first instance to take this on... (so, last resort I think)
I applied for a mortgage some weeks ago and was turned down.
My broker told me to check my credit report (I'd never done this before).
I found that I had a default from Carphone Warehouse reckoning I owe them nearly £700.
I'd had an O2 contract from early '03 and ended it (in writing, as told to when I initially phoned) in Dec '05 and cancelled the DD. I then bought a pay-as-you-go sim.
I heard nothing for 3 -4 months then left the address in April '06.
I was in ignorant bliss about this until August this year.
After numerous emails to CPW I'm getting nowhere. Initially they said they have no record of issuing a PAC !?, therefore, the contract was not cancelled. After I found out what a PAC was, I emailed to say I didn't reuse my old number so didn't need a ‘Port Authorisation Code’. I requested a copy of my original contract.... which they can't find!
In the last email I had, I was told that 'As I didn't use the PAC (that wasn't issued!!) within 30 days the contract kept running!!!! and they couldn't contact me as I moved ...(that was 4 months later!) And, luckily for me, the system ended the contract in '07 or I'd be paying more!!'
I can't believe they have the power to discredit people like this.
I've had nothing form them, they are trying to get me with a technicality, and it seems completely mean and vindictive.
Can anyone help?
