Bit delayed due to the holidays but sent my CCA requests to:
Vanquis
Capital one
Wescot Credit
Also sent default letter to Fredrickson as they wrote to me last week returning my postal order saying that they were no longer instructed in the matter and wrote to natwest whom had instructed fredrickson with the default letter so they don;t try to sell the debt on again. Took ages in the post office getting 3 postal orders and sending 5 letters recorded delivery.0 -
Have received letters back for my cca's and the dca's are claiming they do not believe they are the creditors so the cca legislation does not apply to them. I remember reading a thread somewhere, where ts or oft confirmed that the dca's are to be treaded the same as oc's. Have done a search but cannot find the thread thanks0

anyways i got home from my festive ativitys do find one of my DCA have sent me my pound pack, saying that as i did not give them forthcoming information they can not send me out a CCA,
and i sould phone to comfirm the information. :rotfl:
now a few times they have requested this "informaion" but at no point told me what the "information" should be.

Wait the 12+2 days and then send the next letter! They have still failed to produce a CCA and are legally entitled to do so.
The fact they sent the £1 back is neither here or there - the £1 is a maximum amount they can charge for supplying information - they have chosen to charge you nothing. This part is my opinion only!0 -
I have just received a letter from Moorcroft stating that they have been in contact with the mobile phone company ( my phone got stolen and a bill of over £1,200 was run up with the remainder of the contract added on) saying that it is not a credit agreement however my sister who works for them said it is.. i am confused what to do next they have placed the account on hold until the 2nd of January ive not much time to do anything arghhhh..if it is not a credit agreement what is it do they have rights to pursue it??I am now debt free :j:jsince January 2009
but really need to learn how to save and budget to get some savings behind me :eek:0 -
Hi all, happy New Year!
Out of £59k of debt with 12 creditors, I have 2 currently 'in dispute' for 30 days or more...1st Credit, and Barclaycard after they took over Goldfish Account and started charging inerest...which total £13k.
I know that 3 HAVE got CCA ( I remember signing them ), totalling £21k, but the rest are getting CCA requests for their New Year! Lets see what happens.....then maybe I'll check the filing ability and 'enforceability' of the remainder?

Hi I wonder if someone a lot more knowledgeable than me can please help me? I sent a CCA request to Barclaycard way back in July, and they kept writing to me saying they were dealing with my request but were busy but it would within 14 days etc etc, the final letter I received from them was in September advising they would send it within 7 days. Well its obviously now December and I still have had nothing. I admit I have been a bit slack in following this up due to some very difficult personal circumstances but I now want to know what should happen if I send the In dispute letter? Being a bit dim, I am a little scared as to what happens next?
I do want to repay the debt but I am getting harassed left, right and centre from their various representatives who wont accept my token payment offer. I got made redundant 6 months ago and have been surviving on JSA since then.
During my correspance with them, they agreed to suspend the interest as gesture of goodwill but this is due to come to an end soon and the interest will then start again which will obviously completely swamp me. I owe them just under £6k.
Please can someone advise me on what can happen if I send the 'You have failed to send a CCA' letter etc and whether I should be sending this?
Thanks in advance for any help anyone can give, I really do appreciate it0
