Can i ditch TalkTalk early?

Hi people,
I'm new to the forum as a member, but have used its wealth of knowledge in the past, so thanks to all of you for help you never reailised you've given :D
Now on to my post...
At the end of August i had a TalkTalk salesman knck on my door and start spouting about the money i could save etc. My gut reaction was to close the door, but the thought of saving money got the better of me, so a long story short, i signed to change from BT to talktalk international2 package with "FREE" broadband (which i was then told would be £15p/m but it would be free within months) so i expected a saving of £8 for the initial period and a further £15 savings when the free BB kicks in.
Good package you may be thinking?
Well not quite. Broadband has been very sluggish at peak times, and some sites take a few attempts at connecting (yahoo mail seems to be the worst), but thats not too bad.
I'm promised BB speeds of "UP TO 8MB" and understand that i won't actually get 8mb if my line won't allow it, but 3 seperate BB speed checkers verify my line at 1.8mb and a potential of 8mb with speeds garaunteed betwen 5-6mb.
Then the bills start coming through, and they seem high and added to the fact that i can't change the DD date, i've ended up paying £5 charges on top due to money not reaching my bills account on time, so last night i decided to investigate why and the answer is simple.
I signed an agreement for TT2, and they have put me on TT3! Internet and Broadband seem to be entirely seperate packages, not one like i expected, so internet is now £20 p/m and so is Phone Line. £40 plus DD charges, so the best part of £50. :mad:
I have a copy of the original agreement with a tick in the "international2 with BB" Box, so where do i stand now?
I want out of this contract if possible, and to change to Virgin who can offer me TV on top for roughly the same price.
Any help, or links on this topic would be appreciated.

    then they only should be charging you monthly.

    Line Rental £10.50p
    Call Package £5.89
    Plus the cost of the not so free Broadband £15

    If your paying more then this you need to take it up with them.

    You can cancel the contract but you will incur cancellation fees.However if you think you were misold the product they might let you out of it.

    Yes that exchange was apparently enabled 12/11/2007.

    Bear in mind if you decide to cancel,you probaly signed a contract for 12 months for the line rental/call package,and 18 months for the broadband.Plus if your line has now been unbundled the possibility of having to pay your new provider a connection fee as rewiring will be required.

  • Ok, after a 40 min phone call i got a result, although i haven't been able to leave Talk Talk as the termination fee wouldn't be waivered.
    I called them and pointed out the fact that the contract i signed was for TTI2 with BB and they put me on TTI3 withh BB, so the contract should be void.
    They agreed they had made a mistake and offered to drop the tarrif back down to 2 and reimburse me the difference i'd paid, put a rolling credit on my account for £5 over 6 months due to the fact i'd paid charges for the DD not being taken as a result of them trying to take more than i'd budgeted for them, and thanks to Utilitybroker providing that link, i was able to point out that i should be getting free BB for over a month now, and they had to admit i was right, and put me onto free BB.
    I've also logged a complaint about the BB speed, and they will look into it once i've taken a speed test from a site they gave me (www.speedtester.bt.com) in the morning, afternoon and night and report back to them. They said i should get a max of 6mb, but my speed test at 11.30 was returning only 1.8mb.
    So the end result:
    Tarrif is now £16 instead of £20
    BB is now Free instead of £20 (they admited that they overcharged me there too, should have been £15)
    Rolling credit of £5 for 6 months....
    Means i'll be paying £11 till June, and £16 there-after instead of £40!
    Can't complain ;)

    If you are finding that you are receiving a lower speed that your line can take I would suggest that you test with the modem connected to the master socket, also are you wired to the modem or using wireless, if you are using wireless do you have security on the connection ?

    Instead of burying your head in the sand.

    If you did it MIGHT improve your credibilty on this forum.

    Out of interest what measures do TT take to ensure when an exchange has been enabled the customer is no longer charged for the BB.

    Also can you tell us have all exchanges been completed as samknows suggests, or is their another batch in the pipeline.

    Exactly, thats why i decided to let others know of my problems and how it could be resolved by standing your ground.

    Talk talk-support:
    My line is way below what it should be, and the test done 2 mins ago shows it now running at 1.6mb.
    I am currently using a wireless router, and the security settings haven't been altered, so i assume they are low or not on?
    It is plugged into the main telephone point (i assume the living room is the main one?) so will try it through the Ethernet cable and compare, but i'm not expecting much improvement TBH.
