Had 3 of my cases 'stayed' waiting for the outcome of the test case. Then read that its apparently only applicable to bank charges not credit cards.

So i contact my Local court via phone and ask about it and they said
    (Stoke on trent court)
" Judge Schroeder has stayed all cases pending the test case"
i did reiterate that the test case was for current account holders and has nothing to do with Credit Cards but he said
" Its the policy of this court to stay ALL bank charges claims at the moment "

So have i any other choice than to wait ?

  • If you read Martin's article here...

    http://www.moneysavingexpert.com/reclaim/credit-card-charges#step5

you'll find the form you need to fill in and send to the court but first Martin suggests you write to the court rather than phone.

how long do u have to apply for a stay? i received my letter from the court stating that my case wi barclaycard is being stayed and that was about 2 weeks ago  i hope i'm not too late.

i've rung for the relevant form but should i send that or the 'long letter' (not sure wat its called) thats in this thread>?
Served Court Notice with Abbey
    Barclaycard have paid up :T
Capital One have paid up :T

Written a letter of complaint to Barclays, as apparantly they can't find my Account details
  • Help - Can anyone suggest further action?
My case has been stayed (£800) by local County Court. I've sent the template letter asking the court to unstay my claim and avoid a further £80 fee. The court has replied saying that the principle in the 'Test Case' and my claim are the same and therefore will not lift the stay. Martin can you use my case?

Have you completed a N244 and applied to have the stay removed? This is the next course of action if they have rejected your letter.

Thanks for the reply Nickmack. Its just that its a further £80 fee to pay if I do this and no indication if I can be sucessful. They could still refer to the test case!
