any advice welcomed please!!! my car been towed!

hi ill try to keep it short!! i live in a housing assosiation property with a private residents car park for which we have permits. about a week and a half ago i parked my car as normal outside my gate and the security firm (which appear once a year!) appeared i had to run in my house and retrieve my permit from my kitchen,i said i would be 5 mins which i was i came back out and he had clamped me. I refused to pay and 5 days later they towed my car away. This morning he hammered on my door asking for £1000 i laughed and told him to clear off he was very rude and abrubt i was a bit scared being on my own anyway he threw a form at me and told me to sign it and took my car key he asked for the log book which i refused. My question is what can i do now? can i fight for my car back which i know is not worth much but its the princible i asked to clear the car and he said no way! im really angry! can they get away with what they done? thanks kelly

What was the form you have signed and why did you give your car keys?
When you got the permit in the kitchen, did you displayed it in the car before they towed it away?Be nice, life is too short to be anything else.0 -
I would get on to the HA they after all have given permission for this company to operate on their land0

hiya! thanks for your replies, firstly i had to go get permit as i had only just bought the car! and secondly he made me sign a letter i dont know what its called but its signing the car over to them i didnt have a choice he threatened me saying if i didnt pay the £1000 fine the bailiffs where sitting down the road, so i signed his paperwork,0

We need to start with some basics. What do any signs in the area you parked say? What charges exactly do they say are required for clamping, towing, storage etc? And if the sign does not mention towing and storage what did any paperwork you received when you were clamped mention about those charges?
Also what is the name of the companies involved?
Sadly when they have you clamped they have you bent over a barrel. Best thing to do is to pay with a credit card and then contact your credit card company and push for a charge back under the consumer credit act. You could also take the law into your own hands and cut the clamp off but you can be arrested for causing criminal damage to the clamp.
If you have someone on your doorstep being rude and abrasive you can ask them to leave and if they don't contact the police immediately. Thing is he/she thinks they can get away with anything because they have your car.
This thread would be better placed in the parking section. Also pepipoo forums as mentioned above would be the best source of any information. I do wonder if court action against the clamping/towing company and the housing association (important because they employ the clamping company and are more likely to not want CCJ's against them and pay up) for the cost of your car would do any good - but pepipoo is the place to ask.0 -
