Currently can't complete due to a notice?

  • It wasn't on the HIP report on the 3rd April, although a call to the land registry revealed that the notice was placed on the 3rd April. Our buyer has threatened to sue her ex to get him to remove the notice. We only have 3 days until completion...
  • It just goes to show the importance of having good solicitors! Our buyers solicitor has tried to blame ours and told our buyer last week that the notice was removed.

    As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.

    Sometimes we will do a priority search before exchange but we don't have to - it is up to the seller to sort out anything that shows up that wasn't on the documents produced and the buyer doesn't have to complete until the seller removes them.

    Are you saying that it's normal practice to work on the basis of the LR docs in the HIP right up to exchange, even when those could be pretty ancient if the property has been on the market a long time? Given how cheap a download is from the LR, isn't that rather penny-pinching, perhaps? I appreciate that you solicitors are always under pressure to keep your fees down, of course.

  • They said they can't get hold of our buyers ex partners solicitors and are asking our solicitor to chase them up.

    The land registry have said it's to do with the split of the funds from the house sale.

    Hesitate to open a can of worms but... that's another reason I DIY ! I'll always do a a priority search before exchange even if solicitors don't! Avoids issues like this.

    And yes, it's really the seller's problem to sort out, but it causes a lot of stress for the buyer at the very least. And if there were a chain (thankfully not in this case) there'd be countless others getting stressed and impacted.
