Next Online Credit Account - Legal Advice Please

I have to say i do have an element of sympathy with the OP on this one. About a year ago a similar thing happened to me. The daughter required some clothes ( don't ask :rolleyes: ).
I was working silly hours at the time and had no time to head into a branch. The Next website at no point made it clear purchases were by way of credit account only. Call it naive or lacking in responsibility all you want, but the site is far from clear. Thats plain wrong.
For me it wasn't a problem, i just got on with it. But i can see how people could get annoyed by the lack of transparency. Also, to close an account you have to jump through numerous hoops.
It's all very well saying the onus is on the consumer to check, but an element of fair play should always exist. With Next i don't believe it does...0 -
Next have now confirmed that in February they will make it a lot clearer as to the type of account applying for. Apparently, there will be 2 choices at log-in a) Account and b) cash payment

That is very good news, perhaps they should do it sooner. I dare say they want maximum income from credit before XMAS rush.
Next should be ashamed of themselves. As another poster said, it is not common practice.
It is also, extremely bad form to effectively trap people into credit they don't want and don't need. Next only do this to maximise their profits. Why are lessons not being learned from the credit crunch?
One other issue is that under 18's could be tempted to get easy access to credit this way, by misinforming about their age.
To some of the unhelpful posters above, please treat others like you would wish to be treated yourselves. Some folk are just too quick to jump in and with unhelpful comments. Its not smart, its not nice and it perhaps says more about you than you realise.

Fair enough, long overdue IMO.
Whilst i am sure Next's current stance is perfectly legal i don't believe it acts within the spirit of the law. Like i said not a problem when it happened to me, but i can certainly see how others may fall foul of it.
Anyway i have bigger problems, Lowell financial have done an unregistered experian search on me. :rolleyes: I can only assume for statute barred debt when i was a stupid student 12 years ago. Expect a thread soon, i know they are a favourite on this board.. :rotfl:0 -

Mate, all you gotta do is send a message to experian enquiring as to the legitimacy of the search and dispute it directly with them and request proof that you authorised such a search.

I just don't see the problem. Do the people who complain not read the t&c's?
My wife has a Next account, which we use when we are in the shop, and she puts it on the directory card, and pays it off by the due date. We have never paid interest, and we told them we didnt want the directory and would view online.
No biggie really.0 -

The problem is most people would normally only read the T&C's if they knew they were entering into a credit agreement SDF !
The way the website directs you is misleading. If it wasn't i can't see why Next would have capitulated.
To many people it isn't a biggie, me included. But i can see how it would be to others.0 -
The main fault with their set-up is say you've done a runner from credit liabilities (rightly or wrongly, it doesn't matter) and then as a result of their misleading website you had a search performed - this could allow trace agents to find you thus meaning that Next would have breached DPA as they unwittingly allowed a third party to contact you whom you expressly did not want to be contacted by.
Basically they do have a disclaimer but the problem is in order to buy online you must apply for an account which is misleading. There should be the option to just click and buy. This is what Next have relented with - they will add a new section called apply for a next credit account otherwise the norm will take you through a normal checkout phase to enter your card details.
