Help, Changed mind about rented flat, can i cancel my deposit?

Please help, in need of advise,
Was planning to move in with my partner, we viewed a property last Wednesday. The next day I handed in a covering letter and partial £200 deposit (cheque) to hold the property / take it off the website etc.
Since then we went into the agency on Saturday to collect the forms, a lady told me that they will expect the rest of the deposit in 7 days, basically next Thursday another £425, totalling £625.
Now our circumstanced have changed and we now don’t want to rent.
We have not signed anything yet, but I did notice on one of the agency’s forms, the "declaration" it states that if we pull out, they keep the partial deposit for the landlord’s expenses. But this is a form that needs signed by both of us, and again we have not signed anything.
So basically I want to know, will I be able to get my cheque back? Will they charge me if I cancel the cheque? And if so will I get back credit history because I cancelled the cheque? (Never cancelled one before :P)

You can pull out but the £200 will be kept by the LA. This is exactly why they take a holding deposit!! The LL could have found another tenant and LA have completely wasted their time by sorting everything out for you. Why are you surprised they want a deposit...?!The only thing worse than smug married couple; lots of smug married couples.0

You can try. You could cancel the cheque but a deposit really is that, and by rights they are allowed to keep it, its not there fault you changed your mind although I am sure you had good reason0

I agree with BridgetJones.
Another way out, possible, because you've not signed anything and I'm assuming we are only talking 3/4 days from handing over the deposit cheque.
You and your partner are having personal problems and have decided not to proceed then offer them a token payment of £50 for the inconvenience caused. You might think of something else but anything is worth a try.0 -

If you have had a receipt from the LA what does it say on the receipt?
Were you given any leaflet or letter from them setting out the terms under which the deposit was paid?Since then we went into the agency on Saturday to collect the forms, a lady told me that they will expect the rest of the deposit in 7 days, basically next Thursday another £425, totalling £625.

Depending on the answers to the questions above, you may be able to recoup some of your deposit. An LA can only retain an amount to cover their actual costs/losses so, for example, re-advertising costs to find another tenant etc.

Please accept the enclosed cheque of £200 for the above property of **(address)***** as partial deposit.
My partner and I would very much like to rent this property after a successful viewing at 7.15 on the 8th October.
I will contact you the morning of Thursday 9th October to confirm the above information and discuss details.

We were told verbal that we should put a £200 deposit on it straight away if we were interested by the agent that showed us the property on Wednesday night. I knew from the LA website that a total deposit of £625 was required for the property were were looking at.
I have called the LA to tell them, (told one of other colleagues) still trying to get hold of the person i was dealing with, but after 2 calls, they are still busy and have still to call me back.0 -

Just got mail from the LA, copy of the forms to fill in and a receipt of the deposit. £200, no terms etc, and all form still not signed.0
