    I have not fully read through this all but has anybody used the case law where ppi commission has not been made clear then this could actually where this could mean that even properly sold PPI could mean compensation for people?

    Ummm right next to the quote button:p is how you thank someone. A statement of fact is the events of the case. When you bought the claim to the attention to the company their reactions if you took it too the FOS what was their reaction when you took it to court the company's reaction (use letters received unless you have copies of phone conversations). Your evidence consists of letters copy's of your customer credit agreement, letters between yourself and the company any phone calls made, all correspondance from the court, terms and conditions of the loan and copies of what part of the act you are claiming due too, am proof of mis selling i.e. what insurance you had in place or your conditions which would have made the insurance policy invalid.

    This comes under broker/intermediary law where if their is commision yes they are supposed to declare it (especially if it gets added to the loan) however in most case's the product and insurance is by the company so it won't have any effect barr come under loan arrangement fees and you can ask for a breakdown of this with a SAR.

    Noticed that I have Accidental Death Plan,Accident Cash Plan and Serious Injury Plan or one of my cards which I didn't ask for - can these be challenged the same way as ppi?

    It you were paying a premium then yes it means insurance and if it was optional to the agreement (check your terms and conditions) you have a right to reclaim especially if you didn't want it and you had cover elsewhere.

    I was paying three separate amounts for these things every month that weren't on the account when I first took out the card so definately didn't agree to them when I signed for the card.

    Have you asked the company what those charges are for and when you agreed to them? It might be worth sending a SAR to the company so you have the full details of the card in question and you check to see if they are valid in the terms and conditions.
