stopping nasty phone calls from creditors

I'm sure i have seen something about this on a thread on here but i've just searched and can't find anything.

I'm hoping that some of you knowledgeable peeps will know if its true that you can refuse to deal by telephone under some piece of legislation or regulations?

if it is can anyone tell me the title of the piece of legislation so i can quote it in a letter?

    Dear Sir,

    Ref. XXXXX

    Despite my letters regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue.

    This behaviour constitutes harassment; the letters stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.

    Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to your local Trading Standards office. For your information note that ALL telephone calls are taped.

    Take further note that continued telephone calls after the receipt of a request not to call constitutes a criminal offence under Section 127 of the Communications Act 2003.

    COMMUNICATE IN WRITING – THIS MEANS NO TELEPHONE CALLS, THEY WILL NOT BE ANSWERED, YOUR ‘OPERATIVES’ WILL NOT BE SPOKEN TO.
    HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

    I've also seen the Wireless Telegraphy act mentioned in relation to this but I'm not sure exactly how it works.

    Good letter there - I may have to print a few copies of that!

    thanks keith lard - i have already done those things but unfortunately i have a financial connection to the company who are being really rude on the phone which means they are not making an unsolicited call so these do not apply although they are great links and i would recommend everyone to sign up.

    i'm being a bit slow today :D but which act is your quote from?

    doesn't the law the telephone preference service relies on allow exceptions for companies that you have a "financial connection" with to contact you? for example your bank or credit card company.

    would my opening an account with them invalidate the "unsolicited" part?

    You can choose how they contact you, if you tell them via letter not to contact you via phone they cant, it is seen as harrasment.
    If they still contact you after you have told them 'letter only'
    They are now breaking the law

    This was told to me by CCCS.

    Simply tell them 'no more calls' any contact with me must in future done via post.

  • Unfortunately I am one of those people who call "debtors" everyday. My sincere advice is that you kindly tell them you no longer require communication via the telephone, by law we need to abide by the "debtors" wishes regardless of the amount of debt they owe.
    Also, if the company telephones you at work you can also request they no longer telephone you there. If for instance you say you are at no fixed abode, but they have your work address, companies are allowed to send correspondance there......not telephone if you requested this.

    This would only be due to the company knowing this is the only form of contact they have. So you can DEMAND on the phone the next time they call to no longer phone you, hopefully if it's me you speak to you will be kind.....any of you :)
