Simply 3G refusing cashback....HELP PLEASE

I recently applied for my 12 month cashback (£160) from Simply 3G and they have refused it on the grounds that my November bill was not an origional.
When I applied for the cashback I explained in my covering letter that I did not receive a November bill from 3 and requested another from them which they sent and I enclosed this one with the other 5 bills.
I have written to them again stating that I did not accept their "excuse" to refuse my payment and have threatened them with legal action if they fail to pay up.
I just wondered if anyone has had a similar problem and how did you deal with it ?
Any advice would be most welcome.

if it states in the terms and conditions that you must send the origional i wouldnt think there would be much that you could do - to put it simply its not their problem that you didnt recieve the november bill - but always worth arguing your caseYes Your Dukeiness0

Just received an email from simply 3G stating that following my letter they have reviewed my claim and have agreed to give me my claim minus 1/6th because of the absense of the Nov. bill.
I think it may be thanks to a previous poster here whom I borrowed the wording for my letter from by heading it with the words "WITHOUT PREJUDICE" and "SEVEN DAYS UNTIL LEGAL ACTION" Obviously these company's don't want the bother of legal action. Anyway good result !!! :money:Education is compulsory, school is not.

You should not settle to lose 1/6th because a duplicate bill from the network is good enough. Dont let them get away with it, insist that they pay up the whole amount or a court summon will proceed.0

I have considered that, however after reading the T+C's again it does say that "all bills must be originals, no photo copy, internet printout or duplicate bills will be accepted"
It is extremely annoying because it is obviously not my fault that the bill didn't arrive but I am pleased to be getting at least something out of the sheisters. :mad:
What I may do is bank the cheque then write again and demand the rest !Education is compulsory, school is not.

Good idea to bank it first, then write to them again stating the term not allowing duplicate is unethical and totally extreme, demand your remaining amount or you will take it up with trading standard or the court. Good luck.0

It is worth remembering that T&Cs are in addition to consumer law, not instead of. They can also be unfair and unenforceable. I would certainly be writing to them about it.0

I received a cheque today for £132 which is £26 less than it should have been and has taken almost 2 months to arrive (Almost 4 months if you include the original claim) ! absolutely horrendous treatment from simply3g. Needless to say I will be writing to reclaim my 26 quid ! :mad: :mad: :mad: :mad: :mad: :mad:Education is compulsory, school is not.
