Everest Windows getting deposit back......

Trying to get deposit back from Everest Windows North London Branch, I have decided due to very poor sales and aftersales correspondence that I do not want to spend £18K on a few windows and doors in our 3 bed mid terraced 1930's house but have already given them a deposit of £2,000 which they have refused to give back. Will I have to take them to court and do I have a case?

    Did you sign a contract? If no, then you have every right to a refund?

    If yes, did you sign it in your home? If no, you have no right to a refund.

    If yes, if you signed within the last 7 days, you are entitled to a refund.

    If you are getting it on credit you have 14 days to cancel and get a refund.
    If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

    Yes did sign contract with seven day expiry and the seven days had elapsed. :(

    Would've = Would HAVE (not 'of')

    you can potentially claim your deposit back if the value of the deposit significantly outweighs the loss to the company of you not proceeding with the transaction.

    Plus, it may well be that you have grounds to terminate the arrangement for their breach.

  • Well aside from a very aggressive sales pitch in the contract they claim that if you spend over £20K then you need to pay them 50% before they can begin work i.e start factory work on the cutting the windows to specs etc.....which my argument was

    1) Our costing came to £18k

    2) We had already paid £2,000 and we would then pay 50% when the work began and then the rest when the work was completed which they did not agree with.

    I pointed out that in their contract the amount had to £20k or more for them to want 50% before work began but they insisted that they could ask for whatever the amount especially if we were not taking out finance.

    How many windows? £18,000 sounds like a lot of windows. We paid £3,800 (admittedly a while ago) for 7 with Saveheat......£500 deposit and the rest when they were installed and we were happy.
