Car Insurance wont pay out!!

Hi, i have a car insurance policy on my girlfriends car with me as the main driver/policy holder and my girlfriend as the second driver (as she is still learning to drive). i had a crash in december and wrote the car off, now the insurance company are debating on whether to pay us out as they say i can not insure a car that doesn't belong to me. i did state when i took the insurance out that the car owner was my common law/civil partner and they were quite happy to take my money, but now i need them to do their bit they dont want to and say they might just give me my installments back as they shouldn't have insured me in the first place. they have sent it to the underwriters to see what they say. if they decide not to pay us out do we have a case to take them to court?? Please could you help? Regards Nathan

Sounds rediculous. When I take my car to be serviced if I want a courtesy car then I have yto insure it myself and it isn't my car.
Which company out of interest?0 -
check your policy, does it say under your name registered owner and keeper of the car? If not then point this out to them, if it does, then you are going to need to listen to the phone call when you took the insurance out.0

The devil is in the detail. You need evidence you told them you were not the registered keeper of the car.
Either the onlime proposal or the telephone call you had with them.0 -
You must be fuming! :mad: I am sorry I have no advice but would love to know what happens cos both our cars are registered in my husbands name but I am the main driver on one car (he is second driver) on car insurance. I always say that he is registered owner. If you have told them she is the owner what is their problem? Do they not believe you were driving or something??

1st Central, their customer service is shockingdont hold your breath when they say they'll call you back as they never do!

No it states in my policy that the owner of the car is my Common Law/Civil Partner.0 -

Oh - if they e-mailed the document then you can complain by e-mail.
Make the policy number the heading and copy and paste the following into the text:
"I am dissatisfied that you have refused my claim.
You were aware when you took my premium that my partner was the owner and registered keeper of the vehicle but, because she only has a provisional licence that I would be the main driver until such time as she passed her test.
If you were not willing to accept the business on that basis then you had a duty, under FSA Principle 7, to tell me so that I could look elsewhere for cover.
To take my money when you had no intention of covering me is a breach of Principles 1, 5, 6, 8 and 9.
I remind you that you that you are now required to deal with this matter in accordance with the FSA's rules at http://fsahandbook.info/FSA/html/handbook/DISP and look forward to receiving an acknowledgement of this complaint and a copy of your complaint procedure in the post shortly, followed by your response and a copy of the leaflet from the Financial Ombudsman Service within eight weeks."0
