    Sorry. It depends - grey area. I'd personally say not - given they happen not infrequently and there are a risk inherent in the act of flying. But others may disagree.

    The other point is that, even if a plane is affected by a birdstrike, the airline must use all reasonable measures to get you going again. Look at the so-called third question of the Wallentin judgement.
