ncp parking fine

Hi guys,
I am a sub-contractor working for network rail, and recently got a ticket at an ncp network rail car park. The usual story I didnt have any change, went to go get some aand by the time i got back I had a ticket. The van is in my companies name. So after reading the sticky here i assume the best thing to do is just ignore this?.

Absolutely correct. But you need to tell your company as the follow-up letters will go to them. They need to know it's a fake and that they should ignore also!0

Hmmmm...usually ignore but this is a railway car park and a company van? 'Eeeeees complicated', to coin a phrase known in my neck of the woods!
Some TOCs enforce real penalty charge notices in car parks now. Northen Rail is one who has followed through under Rail Bylaws recently, and Southeastern Railway are mentioned on pepipoo as currently trying to magically turn a fake PCN from Meteor into a penalty-that-never-was-and-is-now-going-to-Magistrates-Court:

And is your company van leased? Massive headache trying to convince a Lease Co that they are not liable and must not pay a fake PCN:

My advice would be to post a pic of the 'ticket' on this forum on pepipoo. Make sure you tell them it's a company van and whether it's leased as well. Register, read the FAQs and a few other threads, and post here:

HTH - I hope you can end up ignoring this one and have to stress that most railway car park tickets are just fake PPC rubbish.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Northern Rail tried two by-law tickets at Leeds mags last week,(715209888cs/b) they failed to show for both, so the cases were dismissed.
Which was a great pity as I was to be first for a nosey in to unravel some of the garble and get a better idea of how they work such tickets, but the cases never got from the waiting area to the court.Hi, we’ve had to remove your signature. I was just thinking to myself the other day about this. Surely railway byelaws don't actually cover private companies do they?
I did a FOI request to the DfT a few months back regarding the P&D PCNs in railway car parks. They claimed to have no data about it and advised I contact ATOC who were under no legal obligation to release the information I wanted (in other words, shut up, go away, we don't want to tell you anything).
We definitely need more research on this however an NCP manager once told me (at a railway station I might add) that they don't actually bother taking any legal action against their unpaid PCCNs because most people "just pay them".0 -
The problem with byelaws is that they can be re-written and replaced relatively quickly which could well mean that if a few serious challenges go in - and are won (and I believe there is a good chance of that) - they will simply be redrafted.
The byelaws provide absolutely no authority to issue penalty tickets to drivers (although there is a specific authority to issue them to vehicle owners).
With respect GTFA the enabling legislation under which the byelaws are made was enacted after the railways were privatised and whether we like it or not there is ample historic precedent that byelaws can be created by and for the benefit of private companies.
Go back to Victorian times and the vast majority of docks and railways (and most large industrial sites and factories) were in private ownership and many had their own byelaws and bodies of men to enforce them - Docks Police, Rail Police and Factory and Works Police. Some still survive, such as those at Liverpool Docks, Port of Bristol, Dover and, believe it or not, even at Falmouth. Some have powers as special constables but are not and have never been overseen by the Home Office and report solely to the company they work for.
I do, however, appreciate that the thought of some private company being able to direct and benefit from law enforcement more than wrankles.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Hi, Just to back this up same thing happened to me, but I was moving house and they attempted to clamp while we loaded (bearing in mind the clampers would have technically been working on behalf of my landlord- work that out) I was just popping in to get my permit, my fault I suppose. they wouldnt listen to reason and eventually posted me a 'fine' i didnt respond or pay it, they sent an offer for half the fine letter next, then a strongly worded letter in red, then nothing. no further action was taken.0
