    Alright NID?

    I've had a reply from Halifax, they say they've sent a reconstituted agreement which does contain my signature and date (copy and paste?) but the rest looks like it's been put together by photoshop and the opening letter reads...

    I have enclosed with this letter a copy of your reconstituted version of the executed agreement comprising both the original and current terms and conditions and a copy of your original signed application form together with a signed statement of the account.

    They've got all of my details typed out on a sheet of A4 then at the bottom they've got a box that says the agreement which goes on about the credit consumer act 1974 which goes on to say about using credit scoring techniques to assess my application and another box under that with an arrow saying just sign here.

    On the back they've got some terms which they've stuck in the middle of the A4 sheet but only have the prescribed terms that they need rather than the lot.

    What's your advice on my next move, NID?

    Lol...yes...but they seem to have indicated that they havent got a signed copy..agreed?

    I read a thread on CAG where someone had asked to go up to Nottingham and have a look and they actually admitted in writing that they scanned the signature side and disposed of the rest. Thats good enough for me considering they seem to send out anything but a copy of the reverse. :)

    following on from Incasso chasing my OH for the tesco loan last week I have now received a letter from Moorcrofy chasing me only for the loan.

    im presuming i should send the prove it letter to start with as tesco still havent sent me the cca as req. which was originally requested 24th feb.

    the letter states:
    we have been instructed by tesco personal finance, to collect your overdue debt of £22740.81.

    It is a legal requirement to sned a notice of intended litigation before legal proceedings in the County Court are issued. We beliee that this letter fulfils this requirement even if it is not actually read by you.

    to prevent our recommending to our client that solicitors commence legal proceedings, it is essential that you settle this debt without delay. Payment should be submitted in full within 7 days or contact made with this office immediately, by telephone 0161 475 2817 or by letter, with your payment offer. Both our client and we do not wish to take this action but if agreements cannot be reached by 20/4/10, a claim may be issued by our clients solicitors.

    We would draw you attention that if Judgment and an order for repayment in full is obtained and remains unpaid, the following enforcement options are available and may be considered.

    1. warrant of execution by bailiffs against goods owned.
    2. application for attachement of earnings order with your present or future employer.
    3. application for a charging order on any property you may own or are purchasing under a mortgage (where the balance outstanding is of a suffiecient level)

    we would emphasise that should Judgement be entered against you this may affect any future credit application you may make elsewhere. We would also draw to your attention that all legal costs incurred are ususally payable by the debotr.

    all payments must be made payable to 'moorvrodt debt recovery ltd' and forwarded with this letter to the above address.

    so they have done as i thouhgt they would, they are attmepting to send 2 sep comps after each of us for the same debt. Is that even legal??

    i snet the prove it letter to incasso last week, and so far have not had anything back. I also sent a huge letter to tesco complaints dept. and letter went to the necessary boides, FSA, ICO etc this week.

    also, may i ask...as tesco have still not sent me the cca as req, merely pestered me for signatures... is there a particular letter i should send.... i looked at the cease and dissist letter - but as this agreement is post 4/07 i aint too sure if that will apply still?

    Well just opened a well deserved bottle of red wine. I've been on all day sorting paperwork into piles all of my debts Phew!. Ive put them away in their own files until tomorrow night after work when I will go through them more accurately to write off for CA's. They are all unsecured loans totaling around £8500 most taken out more than six years ago I think but I haven't scrutinized them properly yet. I have been concentrating on paying off my priority debts first as I am near to retirement age, so those are fine. I have a quantum gas meter for £400 owed The question I have is do I send off a letter to everyone because I only get pestered by about two of them pesky's and do I send a request to take me of their phone database at the same time.

    spoke to you a while back about capitol one,sent them the letters and they sent back an application form,i disputed this with the s10 letter,they wrote back basically saying so what then they placed it with debitas a lot happened in my life at that time and i really was lazy and let it escalate and now its in the hands of bully boys frederick international both myself and the missus was made laid off at work and got a bit down and really couldnt face all this,but now Hellllllppppppp what do you suggest they are demanding 1700 pounds and threatening us with sherrifs and bailiffs any help or advice would be greatfully appreciated

    I am somewhat bemused as to why this account has been passed to yourselves as it is in dispute with xxxx and has been since xxxxxx

    Not only is this a breach of the OFT Debt Collection Guidelines, but also in breach of the Consumer Credit Act, 1974 and Data Protection Act, 1998.

    As xxxxxx are now in default of my Consumer Credit Request and OFT Debt Collection Guidelines, I consider this account to be in SERIOUS DISPUTE.

    As you are aware, whilst my Consumer Credit Act request remains in default, enforcement action is NOT permitted, under s127 this constitutes a complete defence at law.

    Consequently any legal action you pursue will not only be fully and vigorously defended, it will ALSO be averred as both UNLAWFUL and VEXATIOUS.

    Now I would respectfully suggest that this account is returned to xxxxxx for resolution of these defaults and breaches as xxxxxx cannot lawfully pursue any enforcement activities.

    If xxxxx chooses to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair trading, Information Commissioners Office, Financial Ombudsman Service and possible court action.

    I hope that further action will not be necessary and that an amicable solution can be accomplished.

    I would appreciate your due diligence in this matter, and look forward to hearing, in writing only, from you within the next 14 days.

    Hi all,

    I am in the process my credit card agreement. The company has said they will send me the CCA in due course. I did not receive a reply I followed the checklist provided in the forum (thanks it helps alot!!) but they still have not sent the CCA.

    This is what happen:


    1. Request for CCA

    - Reply received account on hold and will send CCA as soon as they can.

    2. reminder letter sent

    - no response

    3. Further reminder letter sent

    - response received that they are dealing with request and the account is on hold. and something about data being processed in line with DPA.

    The 30 days have not lapsed yet but they will do in one weeks time. If I do not hear should i send CCA dispute?

    Need to check I am on right track.

    Thanks Jen.. i was initially going to go through solicitors but the solicitor said they no longer deal with this as there was no point.. and now doing it for myself just got worried!
