  • Hi Nids I think I better start from the beginning as I seem to have confused both you and myself to and I am sorry for that, it just an awful lot to take in.
    In 2002 I took out a loan with LLoydsTsb.
    Defaulted in I think 2004, I think then it was passed to another company who chased it , eventually the debt was bought by Link to which I started paying a monthly payment, that started early last year.
    The reason I spoke to LLoyds on the phone was to chase up the original Loan agreement number and my previous bank account number which they came back and said they had no recollection of me whatsoever.
    I also spoke to Link regarding this as I explained that I was trying to get my paperwork uptogether and the chap I spoke to was lovely and he done a search and told me what details they held regarding the original loan.
    So I have now printed out a first request, I hope this is correct and I will not speak to them anymore.

    Good Morning NID, So still no reply on DH's request I sent off a reminder... and today I got a letter saying

    "......Thank you for your letter.........We will accept a payment of 13.45 a month for X months"

    LOL cute innit?
  • Hi NID don't know if you saw my last post to you #1764 (still don't know how to link back to posts sorry) regarding the gym membership.

    Today I've had a reply from Egg (card not loan)

    "Your Credit Agreement Request

    Dear Mrs XXXXXXX

    Further to your recent request for a copy of your credit card agreement, we enclose a true copy of your agreement with Egg.

    The true copy provided includes:

    1. Document A - A copy of your original agreement which contains the original interest rates.

    2. Document B - Your current terms and conditions.

    Your outstanding account balance, as of the date of this letter, is £4086.50. Your account is currently in arrears. Please refer to section 2 of the current terms and conditions, which confirms when payments fall due to be paid under the agreement and the basis for calculating the amount of the payments due.

    This completes our obligations under the Consumer Credit Act 1974 including related regulations and satisfy your section 78 request.

    For the avoidance of doubt the fact that out have made a section 78 request does not entitle you to withhold your regular monthly payments; as such you should ensure you continue to make your monthly payments.

    If you are having any difficulty in making your payments, or staying within your credit limit, please contact our Collections Department on 0845 6000 296 who will be pleased to help.

    If you have further questions or require additional information, please contact us in writing at the address provided.

    There is a copy of the Credit Agreement and also a copy of my direct debit mandate.

    How do I send you scanned copies of these please, that's assuming that you want to see them of course.

    remember my first scanned CCA from M & S that you had a look at for me, well....
    Today I got the full SAR from the solicitors closing down CCR. This copy shows the same agreement but in the box on the bottom right corner where a signature and date is required by the lender there is a name and date, this is not there in the copy they sent to me!
    Would M&S have deliberatly deleted this from the copy that they sent to me? and do you think it will make any difference?
    i also have the last 2 of my CCA's through, another M&S Personal reserve product and a dorothy perkins card can you please take a look?:o:o
    Im going to go through the M &S SAR now but its BIG:eek::eek: so may take some time. Is there anything I should look for?

    Checked through the SAR now. I noticed that there is no reference at all to the store card pre 2005. Are M & S trying to make out that I didnt have the store card prior to the change to a CC? Are they aware that the variation credit agreement is the loophole? Post 1657
    I have another reserve product from M&S and had the SAR for that too today. This was taken in 1998. At the start of this application form/agreement there is a space where I am asked whether I have an M&S store card (which I did) and asks for the number. It looks to me like this number has been blanked out. Would this again be to erase reference to the store card to make out a varying agreement was not needed? Its like the store card never existed!!

    Just had a call from another claims management company trying to pick up the cases from CCR! No up front fee this time only £30% of successful outcomes!!:mad:
    As if id give up control now! I've waited 12 months to deal with my debts!!
