    We told the due to be new landlord that we could not move until the end of March and now he has turned round and told the managing agent that if we don't move in a week then he will give the house to someone else.

    We have not put any money down other than security checks

    New plan:

    Give current landlord one months notice as they say is required.

    Pay deposit and months rent for new house so we can move our stuff across.

    Not pay rent for current house and tell managing agent to take this out of our security deposit.

    Not a good plan because....your deposit is for reparations and restorations NOT unpaid rent....if you do deploy your plan you will break your tenancy agreement and could be sued (technically of course!)

    We think we have it covered now.

    We are going to give the current managing agent one month notice and also pay for the months rent.

    We are going to put our money down as deposit on new property and pay out one months rent to them too. Managed to jiggle our finances about to manage this.

    OK, starting to get some feedback from Landlordzone. The latest response was that if you are in a periodic tenancy then you can leave at any time without notice.

    Bunny - Some of the major contributors and very knowledgable posters on Landlordzone have also now agreed that, if you are in periodic tenancy, you may leave at any time with the rent paid up to the time you leave. From their comments, I understand that you do not need to give a months notice.

    Also, be sure to read Franklee's post above. Paul F. is an influential member of the letting industry.

  • Bunny, just to back up what others have said, once you have been served a section 21, the landlord has stated his/her desire to repossess the property. Courts will interpret your leaving early as doing the landlord a favour. You can leave anytime as long as you pay the rent up to and including the day you leave.
