The Current "State of Play" a Question?

Options
Ok, the SC went against the OFT,(in my opinion they didn't really tackle it properly)....Other forums are carrying on the fight, with a renewed vigour as the FSA waiver was effectively a waste of 2 years,

To the subject, there has been talk of a Barrister re-addressing the claims so where is this up to?

From my perspective ,There is more than one way to "Skin a Cat" so why so negative?

Most financial analysts on TV this morning seem to agree that this is now flogging a dead horse, and that it's pointless to pursue it.

Those that got refunds were lucky and can keep them, but it's the end of the road for anything else now.

You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)

Do you mean the one MSE Martin hired?

Martin originally said he hoped the revised template letters would be available on this site w/c 14 December
    http://www.moneysavingexpert.com/news/reclaim/2009/11/bank-charges-qa-door-reopened-for-reclaimers

He later revised this implying the template letters were available, but preferred to await the decision of the OFT on 22 Dec before deciding to publish them as he hoped the OFT would take up the case, claiming the legal argument was extremely complex and one that an individual would have difficulty in making stick
    http://www.moneysavingexpert.com/reclaim/bank-charges
(See original text excerpts here: http://forums.moneysavingexpert.com/showpost.html?p=28051095&postcount=22)

Others sources suggest an individual may not only need significant legal help, but also a pot of gold as a claimant could face costs of millions as the banks will challenge and appeal any judgemet that goes against them, possibly all the way back up to the Supreme Court
    http://blogs.news.sky.com/cityblog/Post:d011c198-48f7-4a86-9666-9d7e3f3aa03c

As you can see from the previous MSE link, following the decision by the OFT, the date for publication of the template letters was put back until the middle of January.

In todays email, [23-12-2009] the date for publication is now expected to be in the 3rd week of January

    Update (20th Jan 2010):
In the email from 20-01-2010, it was announced the publication of the template letters has been delayed a few more weeks.
We're still working on the new guide, there's a lot to get through and it's taking a little longer than expected, we hope it'll be ready in the next few weeks. Do remember, while we believe some will still be able to reclaim, for most it will be tough, so plan NOT to get the cash

I'm willing to continue to help people fighting until every single avenue has been blocked, even if that takes another 3, 4 or 5 years. Will you be around for the ride?

Like all things in the media, there is a lot of spin- headline grabbing. Like most news stories, people should take the time to look behind the news and assess what is really happening.

Those that got refunds were lucky and can keep them, but it's the end of the road for anything else now.

Yes, those that have been paid out to date are lucky. However, its not necessarily the end of the road. There are avenues that are being explored and there is hope, however, don't depend on payouts.

Everything is not always as it seems.

The position should be clearer early in the new year.

    Ah, the downside.

Power of consumers is certain to grow. That will aid the cause.

No I'm sure after all the reclaiming has ended (one way or another) you'll still be hanging around the reclaiming board looking for the final one or two people to insult and start a fight with.

But hey, if it makes you feel better why not?! It's Christmas after all!

I've been here longer than you and fully intend to continue to remain to offer my support and advice to money savers :)
