    Hi there

    I'm new to this site however not new to moneysaving!

    Right the situation is this-

    I lost my job a few years ago and therefore was unable to pay the monthly repayments on a HSBC loan and basically dug my head in the sand rather than try sort things out. The loan debt was sold on to a DCA and have now sorted myself out and virtually cleared this debt now with the DCA, however its only from visiting this site i realised i never received a default notice or the fact the debt was sold on.

    Therefore I used to first template letter in this thread to HSBC requesting the CCA and true copy of default notice. No response for approx 6 weeks! so yesterday send template letter 2.

    today received letter from HSBC:

    We refer to your letter dated 2 May 2009 and apologise for the delay in your response.

    Please accept this as confirmation that following the closure of your accounts the debt is now being handled by our collection agents, please ensure all future communication is addressed to:

    Metropolitan Debt Recovery Service
    ***address***

    A copy of your letter has been forwarded to this office and a response will be issued by Metropolitan Collection Services under seperate cover in due course.



    Now basically I have requested the CCA and relative information from HSBC which they are legally obliged to supply me and it seems they are trying to pass the buck. They issued the default according to my credit report so is it them I am supposed to be dealing with not the DCA? Also I sent template letter 2 yesterday so they should receive this possibly today so should I wait and see what their response to that is?, should i make any communication at all with the DCA??

    Yes, spot on - just wait til the ones for this year to drop off and then try again next year, if a decline then wait til they all drop off....

    Thanks for confirming what i thought, but after going through my credit file again i have noticed a that 2 defaults which where paid in 2005 (defaulted in 2004) have satisfied dates of 2008!! Is it worth writing and asking them to correct the paid dates.I have got the letters from back in 2005 stating the balances where cleared!

    The annoying thing is i started checking my credit file last year and it has taken my 12 months to notice!! :eek: will pay more attention to detail in future ! Although if i had done that back in 2004 i wouldn't have the problem now but then hindsight is a wonderful thing!! :rotfl:

    Don't worry, the satisifed dates don;t supersede the actual default date. The default date is 2004 right? therefore in 2010 they will be gone... My advice would be to keep things as they are and stay quiet - just wait til 6yrs have passed then look forward to them dropping off.

    Yeah seems they are just naturally slow at sorting things out. Glad I waited though :)

    Just got to wait till May now then my file will be completely clean :)

    Nope I had that note and I had 2 defaults.

    One drops off in Feb and the other in May. RBS and Egg. Just gonna wait for them to drop off. Even though RBS have admitted to not having my default notice. They say it was computer generated so they cannot provide me with it.

    ahh right, well makes sense not to admit liability now then lol - its less than a year so some lenders will ignore it anyway mate....... by then you'll have loads of history and straight onto mainstream cards lol :beer:

    Well they are both satisfied and completely paid off. They were small amounts. So just waiting for them to drop off. Not even worth pursuing RBS or egg is it? By that time they would be off eh?

    Yeah hopefully this time next year I can start applying for mainstream. I have my Cap1, Vanquis and Three all giving me green zero's so should help me on my way. Got green zeros from my cahoot and mbna accounts too so should be plenty.
