Euro Car Parks PCN appeal help!

Options
Hello,

Just before Christmas I was shopping in a retail park, in Oxford, with my mother - the retail park has loads of huge department stores and so we went into pretty much all of them to buy what we needed. When I parked the car I genuinely didn't notice any of the Euro Car Parks signs stating that you can only stay a maximum of a couple of hours for free. I am heavily pregnant and therefore not the quickest on my feet at the moment let alone when negotiating the shops at Christmas.

I was shocked a week later when my husband received a PCN of £90 for going over the allowed time. He was not the driver that day nor present but the letter is addressed to him as the registered owner.

I wonder if there is any way I could challenge this charge? I do feel it is unfair to allow people to only stay for 2/3 hours when there are so many shops and without the option to purchase a ticket for more time, not to mention the lack of signage in certain areas of the car park.

Any help would be greatly appreciated!

A judge might very well be persuaded that a two hour limit in a shopping centre was an unfair term in a consumer contract, especially if there were restaurants, hair dressers, etc. there as well. Have you complained to the retailers whom you visited?

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Tell us what wasn't clear from the template appeal in the NEWBIES sticky thread that everyone is asked to read, before posting?

    :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
