Gladstone solicitors

Options
Hi
I’m after help. I’ve received a ‘letter before claim’ from Gladstone’s.

I’ve received nothing in the post previous to this letter.
The letter states the fine was originally for £60 and now for £145.

There’s two people insured of the vehicle and neither of us can remember parking there let alone receiving this original fine.

On researching the name of the apparent place the car was parked it appears to be a car park for some flats.
No gate or barrier on the front, just bays outside a block of flats run by a private parking company.
What’s the best way forward with dealing with this.
Any help would be appreciated.

Many thanks

Thank you

    Who is the parking company?

Are the Registered Keeper's details correct on the vehicle's Registration Document - V5c?

    Have you moved home recently?

Thw vehicle's keeper should send a Subject Access Request to the parking company's Data Protection Officer - as described in the first few paragraphs of post #2 of .

Have you read the thread at the top of this board that tells Newbies to read it first?

I've received a 'letter before claim' from Gladstones.
And you've read post #2 of the NEWBIES thread and sent the PPC a SAR, as advised?

To whom does the Letter Before Claim tell you to pay?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It is not a fine, please read the stickies. Also, they may be asking for sums not allowed by law so read this

Can you categorically deny to a judge that you ever parked there, or is this a possibility? If so thus could seriously undermine the claimant. Please name the parking company.

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • Evening.
I am the registered keeper yes.

I have recently moved since the ‘offence made also.

Sorry guys, I have read up on the different links etc that you’ve recommended to me to read but I struggle with reading and don’t take it in too well with my dyslexia.
Not just being lazy but I do find it difficult to read through lots of writing and and absorb what I need to.
The gist I’m getting is that I need to send an email to the company and request a SAR?
I need to go to the location and find out who the company actually is because it just says acting on behalf of our client on the letter from Gladstone’s.
Also, in reply to ‘who does it say to pay’
It says to pay the solicitor now not the company itself.
    Thanks guys

    correct

find out which PPC monitor the parking and issued the pcn, get pictures of signs if you can, even from google street view , they may be visible , or ask a flat owner ? chances are its UKCPM

yes email a SAR to the DPO at this parking company with proof of your I D to get all your own data under the GDPR

If it mentions paying the solicitor, then treat is as an LoC whereby you expect a court claim to arrive from the CCBC in the near future

these complicated issues wont help you because your disabilities make it difficult for you, so ideally you need a helper to assist you , but nobody here would know if you didnt mention them
  • Thanks for your help and advise.
I’ll get on to emailing that tomorrow.
So do you think this will end up going to court? And what’s the likely ness of winning it?

I feel it’s almost easier to pay it but funding is also short so not really an option.
Seem like real bully’s they do.

    yes they are bullies

not even paddy power would give you odds on winning or losing , too many unknown factors and its judge bingo too

nobody can say if it will get as far as a court room, but the odds are that a court claim will be sent , which is the first step in a long process , not all court claims actually get to court
  • Hello,
So I’ve found out who the company is.
    It’s LPS, local parking security.
They do have signs up also.
