Warranty Issue - Labour Charge Being Quoted

In August 2013 an electrician supplied and fitted 6X Collingwood Haler H4 Dim lights which had a 7 year extended warranty.

The lights came with a warranty card to fill out and return but when I asked for the relevant details to fill out the warranty information the electrician said not to worry because if anything went wrong he would take it up with the wholesaler. I have this in writing (an email stating "Don't worry about the warranty card as they are covered by the wholesaler I bought them from.").

2 of the 6 lights have failed and last week I approached the electrician to sort out getting new ones under the warranty. He has since replied that a) the wholesaler denies they had a 7 year warranty (I have forwarded proof of this) and b) that the lights are no longer available so cannot be replaced under warranty anyway.

The electrician is offering to take out the defective lights and send them away to the manufacturer who may or may not be able to repair them. He will not do this, however, without me paying him for labour costs of removing and replacing the lights!

I personally feel this is unfair but can someone offer me advice on whether I have a case or have to swallow any labour fees involved?

    Most warranties have T&Cs, and these usually exclude labour costs in providing the remedy under the warranty.

    Technically you may* still have SOGA rights against the electrician (repair, replacement, refund - his choice, and he'd opt for a refund) as these would expire in August 2019. However any refund you'd get would be partial and would be a very small percentage of the purchase cost for the lights - the fitting cost would not come into the refund equation.


    * May, because you would need to prove that the lights failed due to an inherent fault.

    Did you follow the process on Colingwood's website ?
    (This assumes they were doing this in 2013)

  • I couldn't do the online warranty application because the electrician wouldn't give me the details of when he bought the lights etc which I needed for the form (he supplied and fitted, not just fitted). Instead he told me not to worry as the wholesaler would cover any warranty issues..... it's very upsetting because effectively the electrician upsold me these very expensive lights on the grounds they were covered for 7 years and so were value for money! And they weren't!
