In between stage - cel

Options
Hello,

I have read the newbies post and many other CEL threads but can't quite find an answer for the in-between stage.

I am 4 letters in and have missed the stage to appeal, but have not yet received the LBC letter. I have read conflicting advice so thought it best to ask rather than find out later I made a wrong move. Apologies if the answer is out there somewhere and I have missed it.

So my question is, do I send a response based around the first appeal letter omitting the appeal part in order to set out why the keeper isn't liable, and to ask for all photos and evidence and letters that they intend to rely upon? Or do I simply continue to ignore until I receive the LBC?

To complicate matters slightly I have changed address but still have access to mail at my previous address, do I contact them to update or just leave it?

Also, I have read that it is best to correspond via email, but can not seem to find one listed, has anyone managed to find an email for CEL? The letters seem to suggest that contact can be made via email but none is listed on their website. Should I contact via post?

Thank you in advance for your advice :)

Continue to ignore until you receive a Letter Before Claim or official court papers.

You haven't said who has sent these letters, but post #4 of the NEWBIES FAQ sticky thread tells you how to deal with debt collector's letters.

In fact, given the choice and because it's CEL, would do that, yes.

Base it on the NEWBIES appeal wording so they recognise it, they might give up just because they can tell you are on MSE.

Great thank you. Will this work through the online appeals form? Or do I need to post? As no email available.

    Hi all,

Quick update just incase anyone is following this...

CASE RESOLVED! So thank you for your advice. I used the online appeals process (denying any claim of who was driving and not providing a correct phone number) to send an edited version of the first appeal letter given on the newbies thread.

Instead of receiving the next letter threatening debt collectors once again (as my friend who parked her car at the exact same time and place received), I received a letter confirming the cancellation due to recent communications.

Hope the same works for others!

That is well worth knowing, for other CEL victims, thanks for confirming a late appeal works!

And to think some clueless idiot posting on pepipoo, once said the NEWBIES thread appeal was a 'hatchet job' and unsuitable for a CEL case, LOOOL!!

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
