CCJ-Wrong Address

Hi
Received a Bailiff letter last week for a CCJ I have no idea existed. On speaking to the court transpires that communications were sent to an address where I have never lived or have no connection whatsoever.
Charge relates to piece of land that I own and the company is asking for maintenance costs. I have never had communications regarding this in 16.5 years. My address hasn't changed in past 20 years. Th lady at the court said it should have never gone thru but company went to higher court. I have no idea what that means. Could someone please help with this?
Also,I have applied for it to be set aside. But was just wondering if asked in court, how could I prove I have never lived at the address they have sent the notice to.

    You will have paid Council Tax for the last 20 years. Contact the Council and ask if they will (kindly) supply proof of this. How long have you been with your current utility suppliers, bank, ISP, telephone etc? Any such proofs may be useful.

    Some legal advice may also be necessary; try local solicitors for a free short consultation, if available. What written evidence, if any, does the maintenace company supply as proof that you owe these charges?
    I think this job really needs
    a much bigger hammer.

    In addition to supplying the sort of documentary evidence described by Robisere above, you could also consider filing a simple statutory declaration to the effect that you have never had any connection with the address used to issue the claim - this would need to be witnessed by someone such as a court clerk or a solicitor unconnected with the case - a small fee will usually apply.

    When was the CCJ granted ?
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
