PCM parking fine - question

Evening folks,

I recently had 2 parking "fines" back to back from PCM recently after the permit we paid for fell of the window 2 days in a row. I appealed before reading this forum hoping for a reasonable response, was obviously rejected. Having since read over the newbie post I've been prepared for the several debt collection agency letters, the case has now apparently been passed onto Gladstone who have warned of steps being taken should I not pay up.

I'm fine waiting for the letter that actually states a court date however I noticed that all the correspondence mentions my name. I'm not the registered keeper or the driver but I filled in the online appeal form so I used my name.

They've obviously not checked to see who the keeper of the car is, is there anything I can use here or is it just a formality?

    So how did you describe yourself when appealing?


    (Throughout here you are advised never to reveal who was driving.


    You need to edit your post to remove details of who was driving)

    I'm fairly certain I said "we parked" not mentioning anyone in particular, I made sure to not mention any person specifically.

    It would seem they think you are the driver as a result of your appeal!


    Maybe you ticked driver?? ("Passenger" wouldn't be an option offered)
  • As far as I can remember there was no option to indicate who was the driver or not, just an online form with different fields for name, address, etc. and a box for wording your appeal.
  • I've just check the online appeals form and there isn't anything you need to enter to indicate who was driving or even a stipulation that whoever enters the appeal will be assumed to be the driver.

    If they haven’t accessed the keeper’s details from the DVLA and there’s been no admission as to who the driver is, they cannot invoke ‘Keeper Liability’.

    But that won’t, at this stage, stop them ploughing on. Just something to deal with in due course should this proceed to a county court case.

  • CHECKING: This letter is asking me to pay within "14 days" to avoid further action. It isn't specifically marked a letter before claim, would a definite LBC be marked as such? I don't want to send of a robust reply before I need to, thus giving them the chance to actually address concerns before they're relevant.

    Who is the Gladstones letter telling you to pay?

    Does the reference number on the letter commence 1xxx or 3xxx?

  • Thanks for the quick reply, I realise it might be late.

    Their client is PCM limited, to pay I am to call a Gladstone number or pay online at gslcollections.com. Are they acting as a debt collector?

    Reference number begins with 1xxx, I can scan the letter and edit out specific details if needed.

    Amusingly they say if I need more information to contact "one of the following organisations", wherein they list none. I don't think they're truly interested in helping me.

    That they are certainly not? They’re only interested in helping themselves, not even their client, because should they lose the case on their client’s behalf, they’ll still invoice them for their ‘services’. A ‘no win, no loss’ (for them) arrangement.

    So in the absence of any information to the contrary, deal with this as a LBC and use the LBC response from the NEWBIES FAQ sticky, post #2.

    Additionally, they need to provide you with a raft of information as per the Pre-action Protocol (PaP) and you are entitled to demand all this from them. Don’t be shy in demanding this. Tell them you have no intention of registering with their website to access this - you require them to send it to your postal address.

    Here’s what you’re entitled to receive and they are required to produce with a LBC.
