Planning permission and the neighbour has concerns!

We have just put in for planning permission for a single storey extension but most of it is already there , but we need to redo the utility room and get rid of some outbuildings , how much consideration does the council take when the neighbour has put in concerns on the development we propose??

    I believe your neighbour has full right to refuse. I don't think they even need a reason ! :confused:

    Your neighbour will be asked to give written reasons for their objections. You'll normally find all residents near enough to be affected will be written to by the council (next door both sides and 3 or 4 houses opposite), as well as a notice posted on lamp posts / telegraph post etc in the vicinity. You can also ask friendly neighbours to write in supporting the application, all this will be taken into consideration when the application is heard.
  • The neighbour is concerned that they wont get much light in there utility room and some light in there outsite seating area towards the end of the day when the sun sets, despite the big tree they have there. I think they are being selfish, why would you need that much light in a utility room and its not that we starting the extension from fresh, the building is there but its a bit derelict!

    I wouldn't think that would be much of a problem if the structure is already there, as there wont be a change to their light. If you can get others to write in support when the plans are published this should help offset the objection. You will also have the various other local bodies who might want a say, round to check (Parish councils, Highways people if it affects a road etc) and you will usually get a chance to speak in support when the application is heard. The Planning officer will make a recommendation to the committee but the chairman doesn't have to accept it. I had an application for garage and driveway to access road passed although the Planning people objected to it.

    Are you sure you need Planning permission then?

    Maybe you only need Building Control.
  • yeh we do because of the layout. We would like to square the layout and knockdown the wall to the kitchen and add dininng room and instead of having a flat roof we would like to put a pitched roof. I was told by the planning dept that the descision is officer based, so therefore we wont go to a committee. Would you think than the officer might be more sympathic to our needs and look at the existing layout??

    That should be much easier then, you've only got one person to charm!

    Your building work is going to affect your neighbour to some degree, so calling them selfish seems a bit thoughtless. Have you spoken to them about your plans?

    My next door neighbour (actually behind at right angle as we're on a corner) applied for PP to put a first floor extension over their garage.

    I objected in writing to the council as it would make our back garden very dark and block the morning sun from our back garden.

    I now have a dark back garden...
