Insurance Advice please

Hi Guys,
I would like some advice please.
My parked car was hit on March 8th 2016. The incident was witnessed by my neighbour and a local Shop keeper. The guy too off my wing mirror and scraped the car all along the passenger side. He left his details with the shop keeper. He first claimed he would pay rather than go through insurance but when i gave him a quote of £700 from a local body shop he said to go through his insurance company.
I went through my insurance company who passed me on to Winn's solicitors who would deal with my claim. I was told I would have to wait 90 days for the other side to admit liability. It has passed 90 days and they have told me the other insurance company has not admitted liability and there is nothing they can do. I contacted the guy who hit my car and he claims to have sent off all the paper work.
I can get witness statements from my neighbour and the local shop keeper who both witnessed what happened.
I would like some advice on what i should do now. Can i take private action against the guy? I have his number and don't believe he has sent the paperwork.

If you claimed off your own insurer then why haven't the repairs been carried out long ago?
Your policy won't require you to wait 90 days before any repairs are carried out!0
