Royal Stoke Hospital & APCOA

Hi All,
My daughter has just received 4 PCNs from APCOA for parking on double yellow lines at the Royal Stoke Hospital on 4 different occasions. All 4 arrived on Saturday 23rd Jan however they are marked as issued on the 7th Jan.
PCN 1 was dated 12/11/15,
PCN 2 is dated 13/11/15
PCN 3 is dated 23/11/15
PCN 4 is dated 01/12/15

She is now in her final year at the Hospital University and this is the first time she has received a PCN despite parking in this way before. She was just one of many at University who received PCNs on Saturday, one student received 10.
So the question to the forum is although she has committed the alleged contraventions should she still appeal, is there grounds for the late issuing of the PCNs.
Your help and advice would be much appreciated as the PCNs add up to £200, her total months bursary.

    Thanks for your reply, I have read the Newbies thread over and over but I still can't make my mind up as to whether she has a case for appeal or not, in all fairness to the students parking has been a massive issue on this site, there is no facility for student parking on site therefore they have to park either off site (not easy) or use the main hospital car park which works out at around £10 per day. The main University campus at Keele is several miles away and is therefore not practical to use for parking.

    Most important - did she get any windscreen tickets and was there photographic evidence enclosed?

    Having said that, does your daughter know what real double yellow liones on the road mean??
  • Yes she did have windscreen tickets and yes they have got photographic evidence. APCOA have been dishing out the windscreen stickers for the past 2 years, however this is the first time they have followed up with a PCN.
    Yes my daughter is well aware of the highway code, she is an excellent driver and extremely law abiding.

    your daughter has not broken any "laws" , she has just bumped into a Nigerian scammer with an English accent


    she needs to follow the newbies section and write 4 SEPERATE appeals and post as per the newbies thread (date wise) , by royal mail , first class with POP

    as there were windscreen tickets you should know that under POFA2012 they have to issue the NTK,s between day 29 and day 56 to try to hold the KEEPER liable for the invoices (parking charges)

    whilst I understand there may be parking issues , if its full , its full and I am sure there are other modes of transport to a hospital or university , my daughter in law used the buses at Stafford and my grand daughter uses buses to go to college

    the grounds for appeal are all discussed in the popla examples linked by the NEWBIES sticky thread in post #3, although the initial appeals are all using the blue text BPA appeal as listed in post #1

    in a nutshell, grounds for appeal are

    NO CONTRACT
    POOR SIGNAGE
    NOT A GPEOL
    POFA 2012 errors or non-compliance

    there may be other legal arguments that could be put forward too, so study the popla examples

    I am not sure on what grounds you think that incorrectly parking on double yellow lines could or should be appealed , in that if you cant do the time, dont so the "crime". they need to learn to be responsible for their actions and yellow lines were covered in the driving lessons and tests. parking on yellow lines clearly demonstrates disrespect of the parking rules, even though these are not public roads where penalty clauses apply

    but it is what it is

    I have given you the basics of any appeal , if any apeals should be made (morally or not)

    so if appealing , send in 4 appeals using the template letter in blue text

    then formulate a legal challenge for each ticket to popla, because APCOA will definitely reject any appeals (they almost always do, as do most of these PPC,s) , probably the aftermath of Beavis losing his PE case and now these companies feel they are on a roll

    with so many speculative invoices then every one who has one needs to fight this together .....

    has she / they spoken to any one at the hospital

    has she / they spoken to tutor / team leaders / union officials / department heads

    keep up the good work in supporting her

    Thanks for your replies, I have already told her to visit the main campus with some of the other students involved and try and complain about the whole parking situation at the hospital site, she is trying to organise that now. I fear that the main problem we will have is that this has gone on for a long time and students have got away with it without penalty, however APCOA have obviously decided to take a firmer stance hence the PCNs. I will try the appeals first and go from there.

    I have just worked out that the time elapsed between receiving windscreen ticket and receiving PCN is as follows:
    PCN 1 = 57 days
    PCN 2 = 56 days
    PCN 3 = 45 days
    PCN 4 = 38 days

    This is using the date of issue as the 7th Jan, however if you use the day of receipt of the PCN namely 23rd Jan then the time elapsed becomes:

    1=73 days
    2= 72 days
    3= 61 days
    4= 54 days

    Therefore would I be correct in thinking that only the last one was issued within the correct time period.

    By the way I would just like to say that my daughter is a very responsible young lady and you never know she may save your life one day.

    for a ticket to be compliant with POFa timing is important , once you have sorted that out then you can look at all the other things that might be wrong APCOA as you can see here https://bmpa.zendesk.com/hc/en-us/articles/203653191-APCOA-Parking-UK-Ltd make a lot of mistakes.




    ok date wise , a letter from them should be received between day 28 and 56 after the incident , not before or after. check those dates , not the date they posted , the day you got them.


    all appeals separately , you want 4 separate POPLa codes (which cost them £25 +vat) , and then as this is going on you check that they have asked the DVLA 4 separate times for your info ,
