Virgin Holidays Compensation

Morning Everyone

Just after some legal advice on what we can claim and what we cant...We have booked with Virgin Holidays to go to Moon Palace Jamaica Grande -- Brand new hotel should have opened in Feb...Soft opening 11th July...Virgin are not sending Clients to this resort for July & Aug as it is still a Building Site and not fit for guests...There has been a lot of Social media cover about this as we have been chasing them for over a month to make a decision....
This holiday was to celebrate our 25th Wedding and to renew our Wedding Vowels......
We have bought all the outfits and booked the day with Moon Palace....Virgin has offered us the Rose Hall Hilton(we stayed there 5 years ago).....we dont wish to go to this Hotel for various reasons....Where do we stand by saying no....Do Virgin have to offer us another Hotel or can they just turn round and say Hard luck here is your money...
Moon Palace Jamaica Grande - They have offered a voucher for a free stay for 2 weeks..........
As you can understand we are under a lot of stress tying to sort this out with them....If they had done something over a month ago we may have somewhere to go....
What compensation can we look at claiming for ---eg Outfits - Extra cost for Renewing our Vows(Moon Palace Jamaica Grande have Resort Credits).....Stress....This was going to be a very special holiday and now looks like being ruined......

    Why would you need to claim for outfits?

    If you claim you need to claim for provable losses and costs. Surely the moon palace isn't a nudist resort, so you needed outfits there too...

    Have you looked at what other hotels Virgin has available for your dates, and suggested what you feel to be a suitable alternative?

    The cost of buying our outfits for the ceremony (which wont be going a head)....not sure if your married but assume you didn`t get married in a pair of jeans and a tee shirt......
  • Personally, I don't see how anyone can get overly stressed over things like this but that's just me.

    You could maybe look into claiming the cost for new fitted kitchen also etc.

    On a more serious note, you could always try returning the outfits to the shop where you bought them or save them for when you actually get around to renewing your vows? Seems Virgin have been pretty reasonable here, offered an alternative hotel and going by your post, vouchers for a free two week stay at the incomplete hotel when its finished. Win Win as far as I can see but am I missing something?

    Are you never going to use them now? If not maybe, but you cant claim for something such as clothing if they will just be used on a different date!

    Is the wedding now cancelled? Seems an overreaction to a change in hotel :eek:

    You need to quantify your losses .
    Write down what you feel the need to claim for and what you have had to pay out over and above what you would have paid if it had gone ahead .
    Extra costs must be real not imagined and would need receipts .
    A lot will depend upon what Virgin have in their terms and conditions .
    Virgin are doing the right thing by not sending you to a building site wedding trowels or not .

    Maybe find a hotel that you would accept as a replacement and suggest that to Virgin to see if they move on their offer?

    I'm sure that you can still wear the outfits, and you can still renew your vow, so these aren't really losses you can pursue Virgin for.

    Tripadvisor has some mention of people changing their holiday to the Cancun resort instead. Maybe you could speak to Virgin about that? It seems like they will be able to transfer the hotel and it would just be for them to move your flights.

    Thanks for the comments....yes Virgin has offered another Hotel but this is only 4* and not 5* and iam sure when you are looking at booking your Holidays you find a hotel that meets all your requirements.....so Virgin has offered that Hotel(we have been there before) and that doesn`t meet our requirements......and we have said no.....No mention of Moon Palace but again we stayed there last year and that`s why we choose their new hotel in Jamaica.....the reason we are disappointed with Virgin was that this was flagged by us and also other families(over a month ago) that the Hotel wouldn`t be ready...and it is only since the first guest went out there last Friday that they have been forced into action....There was a family of 50 going for a Wedding and imagine how they must be feeling....Virgin have offered nothing but a change of Hotel....Moon Place in fairness have offered compensation....Virgin made a risk assessment and it has back fired in their face and left a lot of people worried about their holidays......

    Would ask for a better quality hotel (that YOU would like), upgrade on flights etc.

    MAYBE some ££ (NOT VH vouchers) on top, for the 'inconvenience'..

    If have to cancel and book elsewhere, probably now full price as short notice, they ought to repay any difference, as a goodwill gesture?
    breathe in, breathe out- You're alive! Everything else is a bonus, right? RIGHT??
