Regarding the registered keeper..

Hi, I am about to print off and send an appeal to APCOA for a PCN I got in the post for stopping my car where I shouldn't of. I have read lots not to give away the name of the driver, but on the template letter footer from the newbies thread it says to include the {the registered keeper's name}.

Here's my question, as the owner of the car and the one driving it, should I avoid using my name in the letter and just write to them as 'registered keeper'? Or because I'm the registered keeper do I need to include my name for the appeal to be taken seriously?

    if you received a postal invoice treat it as the NTK and just send the template KEEPER letter from the NEWBIES sticky thread, using the same details as were on the letter they sent to you (the keeper named on the postal invoice)

    do not admit who was driving or anything else, dont try to add wording you dont need to

    so name address (as keeper , pcn number

    then the template letter , removing the rant part if you wish, leave the rest alone

    send it with free certificate of posting from the P.O. (not recorded)

    dont just post it in a letterbox with no proof of posting

    its called the K.I.S.S. principle , keep it simple

Secondly, can i ask if i have this right: because in the letter they sent me they have called me the registered keep and not included any names whatsoever, then I should refer to myself only as the 'keeper' and not write my actual name in there anywhere? Only the 'registered keeper' as my name then my address?

    I apologise for my confusion, but i simply just want to make sure I don't do something wrong!

    if your name and address are on the V5C, then put those same details on your appeal, plus the pcn number (reference) , plus use the template appeal (as keeper - dont change this) , send at the P.O. with free certificate of posting ,

    keep the certificate of posting safe, with a copy of your appeal

    If APCOA have sent you a letter as the registered keeper then they already know the name of the RK as they purchased those details from the DVLA. What they do not know is the name of the driver unless you tell them.

    Although OP is not clear, I am interpreting the letter he received as being to "the Registered Keeper" and not his actual name.

    In any event, the advice is to use your name but in the context of RK and not driver.

    The NTK must be addressed to the RK by name. It cannot be addressed to a generic anonymous "Dear Registered Keeper". It must be addressed to a specific person.

    Of course you write your actual name on the letter, name and address.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    So you PRINT your name (don't sign), and IF the actual letter is not addressed to you by name then you add an appeal point:

    x) Your Notice to Keeper (NtK) is not compliant with the requirements of the Protection of Freedoms Act 2012 in many respects, one of which is that it does not specifically refer to the registered keeper by name. As such you cannot invoke keeper liability thus you have no claim against me as keeper.
