Timeshare paid for but no contract signed or sent

My mother in law returned from holiday saying she thinks she brought a timeshare with Regency Resorts in Tenerife

She's transferred the money however said she wanted to check the contract before signing. She hasn't signed the contract however they have posted a certificate without her details on.

Would anyone have any advise of if she's legally contracted with Regency Resorts and if not is there anyway of getting the money returned.

  • A signature isn't always needed to confirm that a contract has been agreed on. As an example, just think of when you buy anything in a shop. You don't usually sign anything when paying by cash and the act of one party offering payment and the other party accepting that payment is proof enough that they have agreed to enter into a contract.

    Timeshare agreements are usually very hard to get out of especially if made with overseas based companies.
    How exactly was the money transferred and what documents were given prior to the transfer taking place?

    Your MIL must have received paperwork of some sort and this should state if any cancellations are permitted.

    there is a cooling off period......but i bet thats long gone,the agreement is almost impossible to get out of.....thousands try every year but very very few get out of them,only if they have told blatent lies (they do) you can get out.but you have to proove it, (that's almost impossible).....surely everybody in the world knows that timeshare is a scam,but as there is one born every minute it must be hard to keep up......

    By law all timeshare companies operating in Europe must offer a 14 day cooling off period, and to avoid this they tend to offer points rather than a guaranteed week. Time is of the essence, she must surely have something in writing, even if it is only the credit card slip. The quickest way of causing a problem to the seller is to contact the bank and ask for a chargeback on the basis that you have exercised the right to cancel under the Timeshare Directive and the company is failing to respond..... Re reading the story you say she transferred the money, did she really contact her bank and do a bank transfer, is so then my plan won't work, but look at the date on the Certificate, is it less than 14 days ago, what is the 'product' described as? so long as there is no mention of 6000 points or something similar send a letter by guaranteed delivery to the address shown and exercise the right to cancel
