Compulsory Holidays

Hi all,

My wife works as a receptionist at a hotel and has gone into work this evening to receive a letter, as did everyone else in the hotel, saying that as the hotel is going through a refurb in the new year, they are making every employee take 2 weeks annual leave, as the hotel will not fully be open.

This is completely out of the blue, and we just wanted to know if they could do this and what rights, if any, does she have to refuse it?

    The employer can dictate when holidays are to be taken. Does she have an employment handbook which states anything different ?

    They were supposed to give her a handbook back in February when she started, but she still hasn't received it. They're not very good at communicating I'm afraid. I'll ask her to ask for a copy once more.

    Holidays are one of the things which must be included in the principal statement (a single document, not the staff handbook).

    Does she have the principal statement of the terms of her employment?

    I *think* (someone with more than half-a-functioning-brain-cell can confirm, hopefully) that if they are saying when she must take her holiday, they need to give twice as much notice? So if they are saying she needs to take two weeks' holiday, they need to give four weeks' notice.

    only the amount of holidays needs to be included.

    When is the holiday due to start?

    Looks like there has been the relevant statutory notice if it is to start on or after the 1st Jan.

    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Not if they are contiguous it would count as a single period.


    but there is enough notice anyway.
