I bought a Vauxhall Meriva 2 weeks ago from Motorpoint, it is 2011 with 18,000 miles. It has broken down twice. Motorpoint are washing there hands from it. They say it is under warranty take it to Vauxhall. It is still in the workshop they can't find the problem. I am self employed and have lost money for the last 3 days. They won't give me a courtesy car as the say they are not sure if the fault is covered by the warranty. Can I return this car to Motorpoint and ask for another car or a refund.
Where do I stand.
Would appreciate any help.
Thanks.

Your contract is with Motorpoint, not Vauxhall. It may be a little too early to reject it. What is the nature of the fault?

Car wouldn't start outside my house on Monday. Then it was towed by the AA to Vauxhall . I got it back on Tuesday afternoon went to go and get my son from school when I got him and got back in the car to come home it wouldn't start again.I got the AA to take it back to Vauxhall again that afternoon and it has been there since.

When it fails to start, does the engine turn over or not?
    What engine does it have?

Is the warranty the original manufacturer's one? If so, has it been transferred to you and do you have all the relevant docs? If not, why is the car at a VX dealer and not back with the seller?

At the end of the day, it is the seller you have the contract with. He has an obligation to you under the SOGA. The warranty does not remove or reduce your statutory rights which the seller appears to be trying to do here.

I bought a second hand car a month ago from a private dealership. The car had a fault in the steering, but they assured me that it would be repaired and that it would be MOTd. Steering fault appeared to be fixed and MOT showed clear with no advisements.
Steering fault has not been fixed (improved but not fixed), has been back twice and still not right. I took it to another garage for assessment today. They cannot fix the steering fault or discover the cause and it has two other faults which, though not MOT fails should have been advisements. Dealer insists I have to send car back to them to go to the garage which failed to fix the fault and missed the MOT faults (Damaged brake & two tyres in imminent danger of blow-out). I refuse to trust them and was told that they "couldn't be bothered with this and that they would not refund the car".

What are my rights? I think Sale of Goods Act entitles me to refund & compensation for incurred costs. I paid with my debit card can the cash be reclaimed through that?

    In Scotland, incidentally.

(Although the day after I returned it, it was advertised for sale on their website again).

That's terrible - they should have had it crushed! :D

Or maybe the 'fault' wasn't that big of a deal, and they took the decision that the next buyer of the USED car may have been a bit more understanding..?

Apologies if my assumptions are wrong, we'll never know of course because only you know the real issue and if it was actually serious.
And that my son, is how to waft a towel!
