Employment Support Allowance (ESA) Tribunal

Hi all,
I need some advice. My dad is currently on ESA as he cannot work due to illness. He went to the ATOS and as everyone else been screwed over saying he only was given 10 pts which is less given to receive ESA, and yet the GP was shocked as he had to issue sicknotes for 6 months each time, its been a year now and i have been given a date for a tribunal.

Now we have tribunal on monday and just wanted to find out what to expect since i will be representing him. I have not had time to go the CAB, as whenever i go they are always fully booked due to less staff.

Any advice would be appreciated.

    This is a video explaining the process.

    Most vital to understand is that your doctors opinion, or if he actually cannot work is largely irrelevant.
    What matters is that he meets enough of the various descriptors.

    Any evidence you can find that goes towards answering these will be most useful.
    This could include letters from people involved in his care, or even friends or family.

    Hi all,
    Had the tribunal today and it looks like ive been done over. It was just answering the same questions as the ATOS doctor, and basically calling the ATOS doctor a lier as he re-worded everything and got completley cross-examined. I was the representative and yet my saying at the end seemed to be completley ignored. The points had increased, but not enough to be awarded ESA. This system is fundamentally flawed as my GPs opinion, mine and fathers opinion seems to be ignored. How can a person be fit for work, when they cant even look after themselves, i really cant understand this. Which employer would employ an individual that spends more time off sick then actually work? I remember i was off sick 1 day and my employer requested a sick note so you can just imagine whether you would still be employeed if you are unable to work for a long periods of time. This ESA test system is a real joke and clearly does not make sense, whilst i was at the tribunal i had seen a person on a wheel chair who had a pot on his arm and was shocked - clearly if disabed people who cannot walk cannot claim ESA what chance has my father got, atleast he walk...only just!

    Any help would be appreciated at this stage...!? looks like another upper tribunal hearing and if not then perhaps re-apply, is their a rapid re-claim for this?

    Naturally you can request a statement of reasons and if the first-tier tribunal has made an error in law you can request permission to appeal to the upper tribunal.

    Alternatively if six months has passed since the date of the original JCP decision that he did not have a limited capability for work then he can reclaim and be paid the assessment rate again - will need to continue sending medical certificates.

    But ultimately the issue is not the doctor or the tribunal or anything else, the issue is does your father have a limited capability for any work and this is set out in the legislation. You need to go through the ESA work capability assessment descriptors and ascertain which ones your father meets and are these sufficient to qualify.

    I urge you to help your father contact a benefit adviser for help.

    Hi, and thanks for the quick response. ESA was declined in Feb 2012, and have appealed since to gain a date today. Yes, according to us and our GP, my father should have gained atleast 18pts, which is enough to gain ESA, however, they were given 10pts at ATOS, and now given 13pts at the tribunal.

    We contacted the benefits advisor before attended this tribunal last year and they said the only options are Job Seekers Allowance or ESA. Now, they cannot claim JSA, as they are not fit for work, suffer from pure insomnia due to pain and this case does not seem to be helping them as i feel they are starting to suffer from depression.

    I will be seeking advice from CAB. Thanks anyway!

    Just to note it is not possible to get 10 points or even 13 points so something is not right there, the points awarded are either 6, 9 or 15.
    Bear in mind also that the tribunal will have had the added benefit of understanding the case law that defines the legislation.

    Also... as a tribunal has found your father fit for work, he could in fact claim JSA (his medical certificate will not preclude this) or alternatively a new claim for ESA and back on the assessment road again.
  • but will a new claim have backdated pay, as they take like 2 months to process? usually send you to atos medical centre and then make a decision? also will the benefit be cut now? as it just says we have been refused and we must ask for reasons? anyone have any previous experiences who can share some light on?

    ESA will be stopped forthwith. As more than 6 months have passed since the original decision, your father can claim again and will get the assessment rate until a decision is made ( as long as he is still eligible due to income or contributions).
  • Thanks for your replies. We have just received a letter saying we will not be getting paid due to the refusal. How is my dad supposed to live? Also we have been advised to claim income support or JSA?

    However, i thought income support was cut off, is it still available? My dad cant claim JSA, as hes not fit for work, so rather than getting pestered by the job centre staff and to avoid the work programme and other headaches that with it, it would be better if he was income support? Does it still exist as i was told that income support is cut off and all existing claimants will be transfered to ESA?

    Any suggestions?

    He can claim JSA, the DWP has decided he is fit for work.

    He cannot claim IS unless he is a single parent with a young child or a carer.
