ESA. Who has to attend face to face assessment?

Does ATOS generaly abided by the following. I realize it is not set in stone but I know someone whose disability/illness would meet criteria in 1 when they are not well, and who has conditions listed on 2 and 3. Will they not be invited to attend a face to face assessment or is it just pot luck with ESA.

There specialist has reassured them they have nothing to worry about because they are not capable of working and if they have any trouble with the DWP they should let them know.

The following is from thefullfacts website.

In 2005 the Welfare Reform Bill, which introduced the Employment and Support Allowance (ESA), had not yet been enacted hence the reference to the Disability Living Allowance (DLA).

For the purposes of administrative scrutiny of cases to determine suitability for inclusion in the DLA in Medical Examination Centre project, 5 categories of case have been devised:

1. Unsuitable for calling to a Medical Examination Centre.
2. Reference to Medical Advisor required for advice.
3. Tentatively invite to Medical Examination Centre.
4. Invite to Medical Examination Centre.
5. Any other Diagnosis.


For each category a list is attached.

1. Unsuitable for calling to a Medical Examination Centre.

Age >75 years
Age <12 years
Both Blind and Deaf
Registered Blind (needs to be seen in own environment)
Cases accepted under the Special Rules defining Terminal illness.
Alzheimers
Amputation of both legs
Asperger's
Autistic Spectrum Disorder / Autism
Cerebral Palsy
Dementia
Hemiplegia
Huntingdon's Chorea
Korsakoffs Psychosis
Macmillan Nurse attending.
Motor Neurone Disease
On oxygen

  • i have hypermobility syndrome where all my joints come constantly out of joint i also have musculoskeletal problems where my muscles dont work im in a wheelchair etc been on dla and incap for 14 years been to every single medical for incap year after year

    The person I know has never had any face to face assessments by the DWP or ATOS at all.

    Since recent benefit changes they have had a couple of invites to work focused interviews at JobCenter+ over the last few years complete with the if you do not attend without good cause your benefit maybe stoped. Which have resulted in them becoming distressed. Until I phone up JobCenter+ and they waive the work focused interview as being pointless.
  • I had it for 5 years without having to go for them but it ran out in may they still paying it to me i got a letter yesterday saying customer compliance officer home visit we need to see you about a benefit we are currently paying you we need to ensure thst your on the correct benefit

    This has nothing to do with ESA though, incap is a different benefit..
    I always take the moral high ground, it's lovely up here...
  • I'm in group two and i'm assessed every 6 months, currently waiting for an appeal and my condition cannot improve, I'm in the WRAG..

    [ am registered blind, and according to the list, i should be seen in my own environment.

    my first ESA50, i had a face to face medical at the job centre. 1 year prognosis

    second ESA50 .... no medical required ... 2 year prognosis

    i wou;d quite happily work full time!

    i have a degenerative condition, that makes my sight almost constantly change. i was born with almost perfect sight. i wasnt treated as a disabled child, and learnt to do everything the same way others did ... by watching and reading.
    i had my own children at a young age and always worked ... but at supposedly 'pocket money' jobs. shop work, bar work ....

    i have academic qualifications, but no type of experience in any sprt of jpb that i may now be able to do.

    just because someone else has NO sight at all. doesnnt mean i should be able to do more than they can. its all about how a condition affects an individual.

    i assume that you have 2 full legs ... but could you beat oscar pistorius in a race?

    I filled in an ESA50, sent it back, not yet heard a thing.

    I suffer from sinus tachycardia which is a fast heart rate, under active thyroid, and depression.

    Still on incapacity benefit at the moment.
