Income Support To Esa Transfer

I received my ESA50 as expected. Filled it out and within a month was sent my appointment letter. Then a couple of days before my assessment I had a call saying due to information received from my GP I didn't have to attend and my file is being passed back to the DWP.

Now I've taken this to assume they are recommending the WRAG or Support group. Time will tell with that. What I can't find information on is if I am in one of the groups will I receive income based or contributions based? I was on Income Support before so my instincts tell me it should automatically be income based.

Anyone with a definite answer on this? Any help much appreciated.

    Interesting they changed their minds on face to face medical.. I'll tell you what I think happened.

    They got your ESA50 and that along with any other supporting medical evidence it was sufficient factually speaking to provide advice to DWP on the WCA with confirmation of information by GP. They duly sent your GP a ESA113 form. They don;t give much time for this to be returned as they're under pressure to arrange medical or provide advice to DWP. Your GP failed to return the form probably within 2 weeks or thereabouts and so a medical appointment was scheduled. Your GP report then turned up confirming sufficient facts to provide advice to DWP without need for face to face medical. They've duly cancelled medical and supplied advice to DWP in the form of an ESA85A report along with ESA113 and closed their file.

    That's what I think happened..lol. I do think it is likely to be good news. I can't answer for sure your question regarding contributions based or income related ESA.. someone will be able to... I understand that as IS is means tested then you'd transfer to income related as opposed to those on Incapacity Benefit who'd transfer to contrib based as IB is contrib based. However regarding your WCA. The DWP may take some time to take a decision.. that decision will almost certainly rubber stamp the ATOS HC advice. I therefore strongly advise you call the DWP and ask for a copy of the ESA85A (ATOS HC report) and ESA113 (GP report/form). The ESA85A should be highly informative as to what to expect... return here if any query on its contents.

    It will be income based as to be contribution based you would have been on IB not IS.

    If they were on IS due to Incapacity then they will be transferred to income related ESA, there will be no contribution based element.

    Do you have a partner?

    If yes, you may have been getting IS as a top up to an IB claim
    So it could be ESA C & IR

    If you don't have a partner then it will be ESA IR.

    No partner so income related it will be. Assuming I'm placed into either group!

    That can be the only thing that could of caused problems for me and yet my GP said to me that I was not capable of work as things are. My GP did indicate how badly the ESA113 is constructed and the way it attempts to encourage capability for work. I think my GP might of screwed up when filling it in.

    I would be interested in seeing a copy of the ESA113 if they will send it.

    I think that ilovenero should also ask for a copy of the decision makers scoresheet along with the ESA85. It probably won't have the final scores yet, but it will show what points Atos gave you. It's pretty much guaranteed that you passed, it's just a question of by how much. That might give an idea which group you will be put in.

    ilovenero, you cannot be refused ESA without a face-to-face assessment, so I am very sure that the news will be good.
