    How can someone give you a complaint letter when it is your complaint and no-one else knows what it is about??
  • It depends what your complaint is about but be prepared for a long and difficult task if you expect any kind of coherent reply. My mum battled with them for a whole year and ended up having to get the mayor and mps involved before getting anywhere and even then had to go to a tribunal for them to accept any wrong doing.
    As i don't know the specifics all i can say is send all letters recorded delivery, they are fabulous at not receiving letters of complaints, make sure all of your information is correct and up to date and that you have everything you need to prove any queries they may have.

    You can request transcripts and a cd recording of all phone conversations you have had with tax credits and when you speak to them always note the time, date and ALWAYS ask for the person who you spoke to for their details.

    Hope this helps a little and don't forget you're taking on a government department they will try and bully you into submission and will try to treat you like you have no idea what you are talking about!

    Good advise from gemmam11 I had major problems getting any sense or response from phone calls and letters, this was for a claim during 08/09. With no correspondence from them at all until yesterday. I had wasted a lot of time and money that I had finally given up but surprisingly I had a phone call yesterday saying that they had just found my complaint file in the bottom of a drawer! nearly 3 years from the end of the claim period.

    If you get no joy asking them to look at it again email your mp, you can find out who it is and their email address online. They have a direct line to the tax office. I did this. It all helps.
    As mentioned, copies of all contact from you and to you, including dates, and send all letters recorded.

    If still no joy you have to do all the work yourself so ask for your files. You can find a SAR type letter on 'consumer action group'. Ask for all your data including cd of telephone calls under data protection act. They have 40 days to send it.

    Near to the date and if they haven't sent it all, get on their backs and start reminding them of the deadline. They had sent my paper files but not the cd. I had to get onto them again to tell them I was still waiting and time was running out.
    It works, cos they record all calls so wont want an unsatisfactory result of them not complying on record.

    If you know you're right stick to it. They cant make you pay up while its under investigation. It took me over a year battling with them but I proved my point and they backed down and wrote the overpayment off.

  • actually it was a new claim for working tax credit as i work as a private tutor for islamic education the case went to band c complaince and the lady handling the case asked for all the bank statements ad tenency agreement and info regarding my work which i provided she still refused the case on the basis that she can not confirm that i do paid work i have a child as well she refused the child tax credit as well ans i think she is being personal and discriminative as to i teach islam and she threateand me as well that she can do stuff

    You 'think' she was being discriminatory. You will need to specify why you think so otherwise there is no basis for complaint. What did she say that made you think that she was singling you out owing to the fact that you teach islam? This is what you need to think about.

    She 'threatened that she could do stuff'. Again, you need to be more specific. If she was advising you of the possible outcomes of the compliance investigation or of other organisations that she might need to share information with (such as DWP or the local council) for example, that is not 'threatening' you, it is keeping you informed of how you may be affected.

    On what grounds did she decide that she cannot confirm you are in renumerative work? What evidence does she need that would fulfil this requirement? Can you provide it? If not, why not? If you have and she has stated that it is not enough, what additional information is it that she requires? - These are things you need to consider.

    When drafting a complaint you cannot simply state your opinion - you have to give the facts which led you to form that opinion. Without the facts, the complaint is baseless and will go nowhere. I'm not asking you to spill the facts here. Whether you choose to do so is your business but be sure that if you are complaining that you give them something that they can actually act upon.
