Challengeyour.com ADVICE NEEDED!

Looking for some advice if possible...... To cut a very long story short, I applied for a refund in mis-sold PPI's from my Halifax credit card(Using the template from this website). This was about 18months ago and Halifax sent me several letters to say they were waiting on the outcome of the "test-case going through court" as to how they handled my complaint.

Then a few months ago they sent me a letter saying they'd now been told to settle complaints and offered me a full refund of £850, which was followed by a cheque for the full amount.
However, in the interim period (about 6 months ago) my wife contacted Challengeyour.com to ask them to pursue the PPI on the same card(and another card that she had).

So.....about 6 weeks ago, Challengeyour.com sent me a bill for £250 saying it was THEM that got the refund for me and that I was due to pay them this as their % of the payout. They'd received notification from Halifax that they'd settled with me directly and to basically leave them alone, but Challengeyour.com then tried to make out it was their prompting that made Halifax pay out.

I wrote Challengeyour.com a letter explaining the situation and that I felt what they were trying to make out was untrue and unethical but I just got a letter back(and abusive call) where they are sending the "debt" onto some legal firm to pursue.

There lies my dilemma really, do I pay up since it was our mistake to get involved with the in the first place? To avoid the threatening letters and legal threat?

or do I stick to my guns and refuse to pay? Can I report them to somebody as I really do think they are trying to tap into an ongoing complaint I had to return my PPI charges.

Advice would be appreciated?

    sorry to hear of your ordeal.

    I would ask them to send you written proof from when they did do the work for you, and contact the Claims Management Regulators through Ministry of Justice (MOJ) below.

    Great, thanks for your help, I'll have a look at those sites.

    Do you think it's worth disputing? I know I've been stupid even contacting them but I do grudge paying out when they've not actually done anything for their bill they've sent.

    I'm a bit worried about the bill now being passed to the legal debt collectors........... Can they put that on my credit file?

  • If the card is in YOUR name, rather than that of your wife (credit cards are only in the name of one or other of you), and you did not authorise them to act for you, I suggest you make a further complaint to the card provider that they have breached the Data Protection Act by disclosing the settlement to the CMC without authority and you want them to sort out the consequences.

    At the same time, I recommend you go direct to the MOJ and complain that they are attempting to enforce a non-existent contract and have been abusive to you.
  • Can I ask this question ? if you were confident that you were able to carry this claim yourself, why did you contact challengeyour.com in the first place ? Also can I also ask about the 2nd card was this claim only put through via Challengeyour.com ? From my understanding they can only charge you if you signed for them to act on your behalf, so somewhere you must have signed for them to act for you. Was the £250 bill just for the 2nd card that you claimed through Challengeyour.com or both ? I understand challengeyour.com work on a NO WIN NO FEE basis, which holds them in a higher esteem than other companies that charge upfront fees.

    I doubt very much a Company as big as ChallengeYour.Com would risk their license for a fee of £250, it sounds to me like Challenge your.com were called in to act when the payment wasnt processed quickly enough, also lets remember there was a 2nd card put through Challengeyour.com
