Admiral compensation?

Hi,
I am pretty new here so please be gentle :p

My husband and I are insured with admiral under a multicar policy. Last night my hubby was on his way to work when he was pulled over for not having insurance. On phoning Admiral it emerged that when we bought a new car last Saturday and swapped the insurance from the car we traded in to the new car they made a mistake and took my hubbys car off the insurance instead.
I spent most of last evening and today trying to sort this all out as the police were forced to seize the car.
We have now got the car back due to a very nice lady in their complaints office, who couldn't do enough to help us, she listened back to our conversation on Saturday and admitted they were at fault and to this end have agreed to pay the pound and recovery costs. We have yet to find out if the police have quashed the penalty they issued of 3 points on his lisence and a £200 fine.
The lady I was dealing with today said her first priority was for us to get the car back before xmas and 'we'll sort out compensation after that' SO my question is what should we expect or request in the way of compensation?
I have no intention of being greedy, but all of this has put both me and my husband under a lot of stress and inconvenience and I'm not sure what we are entitled to.

    have they agreed to pay the impound fees or reimburse you? (you will have to pay and send the invoice into them to confirm)

    you will need to arrange a letter of idemnity from Admiral to provide to the Police to confirm their error and that there was cover inforce at the time of the stop. Although Admiral have admitted their mistake they will not contact the police (some Forces will actually contact the insurers at the roadside if there is a possible error).

    In regards to compenstion I can only say that I have seen our company pay upto £500+ for the same error. You will need to write in detailing events and the inconvenience it has caused.

    Wait and see what penalty he ends up with before agreeing any compensation.

    If he does end up with a fine and points then you might want to let your solicitor sort out compensation for you - eg. your future insurance premiums will rocket, in that case maybe Admiral can promise to cover you at normal rates till the offence is no longer declarable.

    (And will any points he gets over this push him into or close to a totting up ban? All needs to be taken into account when agreeing compensation!)
  • vusys1 - The pound would only accept payment by chip and pin in the office so I had to pay it and Admiral said they have reimbursed me by petty cash this morning, however I am yet to check.
    Also I have a copy of the letter of indemnity already with a hard copy in the post, this is how I was able to get the car back yesterday.
    The lady I have been dealing with has been really good, when I spoke to them this morning she offered me £100 compensation but I declined it and said they will have to sort that out with my husband after xmas.

    Quentin - We have sent off the slip asking for hubbys ticket to be dealt with by court, it will probably take a few weeks before they decide if they will quash it? I have outlined this with Admiral as well. Luckily he has an otherwise clean licence.

    Me and hubby don't think £100 is fair being as he was stood on the side of the road for an hour trying to sort it all out, he was late for work, used a lot of credit on his mobile, not to mention the amount of stress and anxiety it has put us both under over the past 2 days trying to sort things out.

    We'll see what happens after xmas...

    This isn't what most in your position would see as "really good".

    A reputable company wouldn't be trying to get out of this by offering £100 at this early stage!

    What they should be doing is offering all asistance with the ticket/court case, and awaiting the outcome of that before turning to the issue of compensation.

    Definitely don't accept any "full and final" compensation offer until the whole issue has been concluded.

    In the meantime ask them to assist you over the court case by funding your solicitor and agreeing to pay all costs/fines etc that arise over any hearing (to include any loss of earnings etc you are involved with in attending a hearing).

    And definitely consult a solicitor if you do get a court summons over this. (This could be some time away)

    no need for a solicitor, their letter of indemnity will be enough for the court.

    Well 6 months later and this has eventually been 'sorted' but only after having court summons!!!

    Hubby had a 'word' with Admiral and they finally got their butts in gear and contacted the court and got the case dropped. I am awaiting confirmation from the court by post.

    Now Admiral are talking compensation...today they have phoned and offered £250 :angry: I'm not being funny here but this has been hanging over our heads for 6 months!!! I have also had all the extra worry of us having booked to go to the USA before this all happened and panicking over whether we will be able to go due to the possiblity of him being charged.
    I want to know if others think this is a 'fair' offer (I don't) and being as it is open to negotiation, what is 'fair' to ask for...(I have a figure in mind, but don't wish to disclose it atm :))

    I don't think that's enough.
    I was worried about a holiday recently over a funeral. That wasn't anyone's fault but I understand the stress. I almost had my bag packed but didn't know whether I was going.

    Off the top of my head - I'd say double - £500.
    But I'm not sure how you actually assess this kind of thing. I guess ultimately you'd have to go to court and it's probably not worth it even more stress) but I'd certainly push for more and detail all the events & stress, e.g. holiday if you haven't already.

    BTW - that's purely my lay persons gut feel.
    Ideally you'd need a solicitor to tell you what it's worth, but I would guess it's not worth paying for a professional opinion.
  • Well, they have said its open to negotiation over the phone, me and Hubby are to 'talk it over' and get back to them, I think they are being a bit cheeky and I'm sure the woman we have been dealing with knows we won't accept their first offer. I don't think we will need to involve the courts or a solicitor in this case, but thanks for your input :)

    This is something Admiral could have/should have sorted out within 15 minutes of the event: ie when your hubby was stopped roadside.

    Normally I'd expect the Police to drop the charges and the impound fees after being given confirmation from Admiral it was their mess up.

    Why not be really cheeky and ask for 1 years free insurance ;), actually they may have to take a token off you to make it a legal contract..........£1???
